    Thanks Nigel. I guess the OP should attempt an appeal to the PPC (as the RK NOT as the driver) and ask for a POPLA code - a separate appeal for each ticket, and see what the reaction then is.

    On the basis of that reaction, assuming the 'usual', frame a very strong complaint to the BPA (the points in your previous posts should be very much incorporated in it).

    At the same time, continue to ignore Roxy as the only thing that will get rid of them is a fat, juicy cheque in the post (OP - ignore means make no contact with them and if they phone you tell them that any alleged debt is denied and for them to refer the case back to their client, don't engage in any further discussions with them, phone down!).
    Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

    So they have never sent a compliant Notice to Keeper and what they did send was too late for POFA to apply. I would not try to second-guess what the PPC's intention is (whether they aren't bothering with POFA and rk liability, how can a lay-person guess?). The point is the debt collector is hassling you as registered keeper with no cause to do so.

    Same advice as I gave before applies, I reckon. Complain to the BPA and let them deal with the PPC and maybe these will be cancelled. Say that it appears from all the letters that all parties are trying to hold you responsible as keeper which is not allowed because the PPC has failed to meet any criteria for sending any 'Notice to Keeper' and the 'formal demand' was late and misleading. May as well throw it in the BPA's lap.

    DO NOT start by talking about the tickets or the incidents in case you infer to the BPA who was driving. The BPA are not on your side so talk only as the 'registered keeper' who has had enough of this harassment and wants the BPA to deal with the AOS member. The BPA will want to see the letters and may well take action to quash these even though they are on the PPCs' side.

    As I said above, it's your best chance to get the dogs called off (they are toothless dogs but annoying and yappy with all this junk mail!).

  • I'm fairly certain I've not received anything else. I spend time between 2 locations and have checked both but have no other letters.

    So I should write to the boa complaining they have not followed the correct rules?

    Shall I bother writing to care parking and the legal firm or just let boa contact them.

    I'm also thinking I should tell the managing agent at the complex as the company they have brought in to manage parking are obviously not following the correct code.

    What should the letter include? Any specific words / references to paragraphs??

    Dear BPA

    I am the registered Keeper of the car **** and am writing to you complain about 2 of your members, Care Parking, and Roxburghe

    The Registered keeper has received a letter dated 4th June 2013, regarding a PCN issued to the car named above regarding it displaying an invalid permit. Under Schedule 4 paragraphs 8(5) or 9(5) of the PoFA states that regarding letters sent to the owner: (Where a notice to driver (parking ticket) has been served) Not earlier than 28 days after, nor more than 56 days after, the service of that notice to driver.

    In the letters addressed to the registered Keeper it states a PCN was issued on 9/4/13 and another occasion of 23/3/13. However these letters the registered Keeper has received are dated 27/6/13 and 4/6/13.

    Both of these letters are in breach of the above code as they have been sent in excess of 70 days from the alleged ticket being issued.

    It would appear from the letters that all parties are trying to hold the registered Keeper responsible which is not allowed because the PPC has failed to meet any criteria for sending any 'Notice to Keeper' and the 'formal demand' was late and misleading.

    Further to receiving these letters, the registered Keeper has received a letter from Roxburghe which clearly has your logo on the bottom of the letter, stating that the registered Keeper should have paid this penalty charge notice. The letter clearly states “we are further advised that you have confirmed that you were the driver at the time of the unauthorized parking event..” Under NO circumstances has the registered Keeper made, or attempted to make contact with either Roxburghe or Care parking and this is just a fabricated pre formatted letter, in order to scare the registered Keeper in paying this PCN.

    It’s also distressing that in Care Parking’s letter(s) to the owner they attempt to blackmail t the registered Keeper by sating “Failure to provide owner / driver details or the payment of the full amount of £100 within 28 days of this notice will result in an increase to £150.” This is clearly trying to add pressure on the registered Keeper to provide details, which legally the registered Keeper does not have to do.

    I look forward to hearing your reply about these 2 members of the BPA.

    I am simply planning on ignoring this letter but after some advice if this is the best thing to do.

    IN the letter it states "we are further advised you have confirmed you were the driver" yet i have not provided any corrispondance with care parking.

    Bother to do ALL THREE. But it's the BPA not 'boa' (see email already given for you) and your complaint to the Managing agent needs to be stronger, like this one:

    That worked, fake PCN cancelled by the Retail Manager because she complained loudly enough as an angry potentially ex-customer (not just saying 'your parking company aren't following a code').

  • here's a question then, and one to ponder,

    If the car has to display a permit, the property is rented, then who is responsible for renewing the permit?

    if they can only take you to court for breach of contract, who breached it? the owner, driver, or person assigned to the flat, in which case, what happens if there is 2 names on the lease??

    surely this opens up loads of other avenues haha.

    just curious to see what you all think...
