adidas online. custom made trainers

Hi guys, just looking for a bit of advise to see if there is anything at all that i can do.

On Monday night I ordered 3 pairs of trainers from adidas. 2 pairs of standard shoes and 1 pair of the mi la custom trainers. I ordered a uk 7.5 for each of them as thats what I usually wear.

The 2 standard pairs arrived on thursday and they are slightly tight. I rechecked the size chart and they say a UK 7.5 is equivalent of a us 8 (usually 8.5). So im now thinking maybe a size 8 would be better.

The problem is i tried calling customer service and explaining the problem esp with the mi las. however they are saying that once the order is placed it cant be changed at all even though it wont be shipped for 3-4 weeks.

Im returning the other trainers but now think i will have wasted a lot of money on the custom trainers. their website does state no returns on them. is there anything at all i can do? just wnat to check before I just accept it.

    Did you buy them from a UK company? what form of customization did they supply?

    Hi it was the adidas.co.uk website. it was just colours that were changed. nothing else
  • The Distance selling regulations do allow for a change of mind for many products, this doesn't apply for personalised or custom made goods (unless the customisations were chosen from a list of available "off the shelf" options).

    Looking at the website for the shoes:

    it does appear to be the case that each pair of shoes is specifically made to order and therefore is not covered by the right of cancellation.

    And you selected from a drop down list (or similar widget) or pre-supplied colours?

    If so you have the right to cancel under the Distance Selling Regulations. Customized items are excempt, but selecting options from a supplied list is not customization.

    You will have a minimum of 7 working days (starting the day after delivery) to cancel. You don't have to wait until then though, you can cancel at any time.

    Cancellation needs to be in durable form, so a letter or email but not a phone call.

    yes the colours were from the choices they gave me. but i think this does mean they go to get made. does this still mean i can reject them? or even write a letter now?

    My opinion would be that you don't have the right to cancel.

    In their explanation of the DSR's, the Office of Fair Trading state that
    Unless you have agreed that they can, your consumers cannot
    cancel if the order is for:

    the supply of goods made to the consumer’s own
    specification such as custom-made blinds or curtains.
    This exception does not apply to upgrade options such as
    choosing alloy wheels when buying a car, or a combination
    of standard-off-the shelf components when ordering a PC


    and I don't think that what you have ordered would qualify as "standard off the shelf components"
    as you can specify different materials for 3 parts of the shoes, multiple colours for other parts, having a name embroidered on them (even though you didn't choose this) and then having them made to order in a specific size.

    I would also say they are being customised as you are chosing the material etc. so are not covered under the DSR right to return
