You need to understand that parking companies routinely refuse recorded delivery letters, just send it with proof of postage. It's presumed delivered after 2 days, they actually do the same presumed delivered themselves.
When posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. They DO monitor the forum.
We don't need the following to help you.
Name, Address, PCN Number, Exact Date Of Incident, Date On Invoice, Reg Number, Vehicle Picture, The Time You Entered & Left Car Park, Or The Amount of Time You Overstayed.

Not recorded delivery to actually prove that they received it? Surely in standard post they could just get my letter, bin it and then claim it never arrived?

    You are so frustrating.

You have been given stroma's qualification to advise you, and your continued questioning of the advice you are freely given is becoming insulting.

Maybe you should pay your own solicitor for advice. Then you can sue if its incorrect.

And asking the same series of questions on PePiPoo. In danger of being cast adrift, which I warned about in post #30 and now we're at #55 and not much further forward!

Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

I will get the appeal letter sent and get a POPLA code. I will the formulate my appeal to POPLA from the templates already available. I may ask for a review before sending it to POPLA and will make no further posts on the matter until my POPLA appeal. Many thanks to all again

    Unbelievable.

  • Hi all, I have a similar situation, except I had a senior moment and forgot to put the permit out. However, the car was parked in my underhouse space of my flat which I own! My 1st view is what right have they to come in there and put a ticket on. The 2nd is "why would I pay for parking in my space"! I have written to them twice now. The letter received yesterday said that they feel I was in breach of rules, I was correctly ticketed, but that they would reduce the fee to £15. Initially I thought, sod it, I might as well pay. Then I read the final of 3 options they had given me. To not pay, attract debt collectors and finally court action which "may result in further costs and affect my credit rating". That is offensive and now makes me think, right - bring it on, not pay and tell them to take me to court. Any thoughts anybody?

Please start your own thread. Trying to advise two people on the same thread just leads to confusion for everyone.
I'm a retired employment solicitor. Hopefully some of my comments might be useful, but they are only my opinion and not intended as legal advice.

Nas786, does the development on which you rent a flat have a residents management company?. If so, then they will have elected directors who in turn will have appointed the management company that carries out the day-to-day running of the development.

These directors can be held equally liable for any claim for costs resulting on action arising from PPC tickets. This is the one reason why we do not have a PPC to control the parking on our site (we prefer to approach those who use it as a free car park for the rail station & explain that the parking bays are not for their use & that a number of vehicles have been broken into with no one seeing anything (they haven't, but the illegal parker doesn't know that)).

I, or course, the development is owned by a single freeholder other than a residents manco, then you could stir the muck by writing to them and informing them that you find them jointly liable in any Court claim for harassment by the PPC.
