I have amended the draft letter to take account of the fact that you are renting. Now just send it. No more prevarication. Do it now.
UKCPS will refuse your appeal, but that is par for the course, the important thing is that will get you the POPLA code, and provided you follow our advice
you WILL win at POPLA.
However, as Stroma says, while we are spending time on here going round in circles with you, we are not spending time helping people who are willing to help themselves. For that reason, I am bowing out now until you have sent in your PPC appeal and obtained a POPLA code.

Please send what Daisy has obviously taken time to draft for you, as you can see by her signature she's a retired solicitor, so you have basically what a solicitor would send to a company for free.
I expect your next post to say the letter/email has been sent, I appreciate you are looking to do due diligence on this, trust me it doesn't get much up to date than this thread, it gives the advice as it stands today.

Gosh no. I just want to make sure that I get everything right so that I can pass on all this to other residents in the flats. This way, as a group we will all know what to do in the event of PCN's.
I don't know what others in the flats have done when they received PCN's (I have seen them on cars). But if I'm able to go through the correct proceedings and wordings, I'll be able to help the others.
So I hope you can understand why I'm so keen to make sure that this is quashed and the PPC will realise that we will fight back. And I certainly wouldn't be able to do this without any of your help and advice!0 -
Just one question before I fire off my appeal letter.
The NTK I got was the first I knew about the PCN. So if I saw no ticket on my car, should I ask the PPC for photographic evidence in my appeal letter? Or should I wait for my POPLA appeal and then the PPC will have to submit it to POPLA as part of their evidence.
Please advise on which way round would be best0 -
You could say 'the driver found no PCN at all on the car so I need to see a copy of it if you should reject my appeal as registered keeper.'
Remember you are only writing as 'the keeper' (not as 'the driver' who is talked about only in the third person; do not say 'I parked' or suchlike).PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Just send Daisy's excellent letter which she took the time and effort to draft for you. You are in danger of missing the chance of getting a POPLA code if you procrastinate for much longer as different parking companies have different time scales for accepting an appeal - it doesn't really matter what you say - they are almost certain to reject it - you just need to go through the formalties to get the POPLA code. UKCPS state on their website you need to name the driver and keeper - YOU ARE NOT UNDER ANY OBLIGATION TO DO SO and they cannot withhold a POPLA code for this.
If I were in your situation - I would also write to your landlord explaining the situation and how distressing this is for you and state you feel you are being harassed and intimidated and that if he/she does not intervene personally to get this charge cancelled you will contact the Rent Officer at your local council. (There are a number of laws surrounding harassment of tenants). You could also add that if you are forced to pay this charge at a further stage any amounts would be deducted from the rent. Remember your contract is with the landlord and you are paying rent for the flat and associated parking space - the landlord employs the management company - who have then employed the UKCPS who probably do not have the landlords permission.0
