(There are a number of laws surrounding harassment of tenants). You could also add that if you are forced to pay this charge at a further stage any amounts would be deducted from the rent. Remember your contract is with the landlord and you are paying rent for the flat and associated parking space - the landlord employs the management company - who have then employed the UKCPS who probably do not have the landlords permission.
I tried the letting agents but they declined to intervene as they say they have nothing to do with the management of the buildings. Might contact the council and see what their views on this are though.
Yes I will send the excellent letter and am grateful for having the support of the experienced forum users. This is my first experience of an issue like this, so being a novice, I'm sorry if I've come across as panicky and anxious0 -

The Letting Agent is yet just another intermediary between you and the landlord. Your original contract should have the name and address of the landlord - just use this and write directly.0 -

Also, what are the official BPA guidelines for signs? Am I correct in thinking that one of them is that the main letters for the signs must be at least 5cm in height?0 -
You can check out the guidance contained in the BPA Code of Practice here

However that point is not needed for the first appeal to the PPC, so please don't use it as an excuse to delay sending your appeal to the PPC.
Also once you have sent off your appeal, you need to be doing some reading about POPLA appeals. Go to the POPLA decisions thread at the top of this forum and read the most recent decisions. Then put any of the following keywords into the advanced search box at the top of this page:
POPLA; GPEOL; genuine; loss; contract; appeal
click on the parking forum (right hand side)
And start reading (choose threads that started within the past 3 or 4 months to ensure the advice is up to date).
Then prepare your first draft appeal to POPLA and post it here and the regulars will help you to finalise it. But they won't do it for you, so you really are going to have to start doing some research for yourself.
DaisyI'm a retired employment solicitor. Hopefully some of my comments might be useful, but they are only my opinion and not intended as legal advice.0 -
Reading through all the guidelines now. Already starting to put together a POPLA appeal so it's ready to send off as soon as I get the code. Of course, will get it checked by the experienced posters on here first.
Think I'll be able to find some grounds for appeal and be able to put a good one together with the help of templates and you guys0 -
Have u sent of your letter to the parking company.. . Km if not why not......
You shouldn't need to ask endless questions about popla as there is more then enough stuff to show how to win.Proud to be a member of the Anti Enforcement Hobbyist Gang.:D:T0 -
Yes letter will be going off this week. I do not have a printer so have to wait till I'm in work. The letter states 28 days from the date (date being 5th Oct) but know the sooner they get it the better0

Get a proof of postage from the post office for freeWhen posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. They DO monitor the forum.
We don't need the following to help you.
Name, Address, PCN Number, Exact Date Of Incident, Date On Invoice, Reg Number, Vehicle Picture, The Time You Entered & Left Car Park, Or The Amount of Time You Overstayed.
