I had a POPLA code. My POPLA appeal failed. After reading Daisy's thread on LBCCC's I noted that its not too late to give them the driver's details (my husband was the driver and I was the passenger and the RK). In this case, it would reset the clock and give us another chance to appeal with the usual winning points as per the sticky notes.0 -
Just send a complaint email to Steve Clark of the BPA (see post #6 of the NEWBIES sticky). State that you have complied with POFA2012 in giving the name & address of the driver before any court proceedings and yet PE are still threatening you and haven't written to the driver as far as you are aware. Do not put stuff like 'this will reset the clock' or 'this will give us a second chance to appeal'. Remember the BPA is not on your side, it represents the PPCs.
(The fact you've lost at POPLA already as keeper is irrelevant as long as you have named a different driver). And you have told the truth throughout - you were NOT driving so you have now at the last gasp, but in time, discharged all liability despite the POPLA loss. Tough, PE!PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Ah yes - sorry - just refreshed memory and re-read whole thread again.
As coupon says complain to the BPA for breach of their COP and also complaint to the DVLA for breach of KADOE contract.
Dear BPA,
I am the registered keeper of vehicle registration number xxxxx and wrote to Parking Eye on xxxxxx discharging my liability under POFA 2012 schedule 4. The name and address of the driver on the day of the alleged parking contravention was supplied in order for Parking Eye to issue a parking charge notice.
Parking Eye have to-date refused to acccept this discharge of liability and are still attempting to pursue me for this parking charge and are threatening legal action.
This is a direct breach of your code of practice by which Parking Eye must abide by for the pursuance of parking charges. A formal complaint is also being made to the DVLA regarding this issue as this therefore contravenes their KADOE contract.
In view of this serious breach, I therefore request that you instruct your member to cease pursuing me in this matter and contact the driver in this instance.

Thanks for the template. Home Bargains are responsible and have a contract with PE. I spoke to the store manager who said that I need to pay the parking charge because I was in breach of the contract! Don't think he understands the EA. He said there is nothing he could do and that I should contact PE directly.0 -

Also you should tell home bargains that this is their responsibility, talk to the manager again and give him/her a letter with this

The expenses I may claim are not exhaustive but may include the cost of stamps, envelopes, travel expenses, legal fees, etc. By continuing to pursue me you agree to pay these costs when I prevail.

To me the manager seemed absolutely useless at this. He said that the head office deals with Parking eye and he has nothing to do with it. He said that I was at fault by overstaying so I should pay the charge or take it up with parking eye directly. It just seemed silly speaking to him. It was like talking to a wall! He wasn't listening. To be honest I think he didn't care. There is no personal implication to him if he refuses to co-operate. I am very surprised though that the letters I sent to the CEO, have had no effect either.0 -
I believe the only way HOME BARGAINS will ever sit up and take notice will be if somebody actually takes them to court for breaking the EA 2010
the same applies for THE RANGE too0
