This is exactly what is wrong with POPLA - the remit of assessing appeals revolves around the PPCs contract terms "signage" and how that is related to the BPA COP "legal" terms .
The BPA endorse that PPCs can issue tickets to cars parked in a disabled space without displaying a blue badge - the scheme which is not even relevant on private land. There is also no legal powers of inspection for correct usage of blue badges on private land by anyone - even the police or council officials can check the validity on public land.
Primary legislation such as the various protected characteristics under the Equality Act do not figure at all - which is why shamefully in the early stages so many appeals were lost by forgetting to display a blue badge or the blue badge not correctly displayed etc.
POPLA also seems to forget the legal niceties when it comes to making decisions regarding parking charges issued on residents own spaces - where their lease gives them overriding rights. These appeals must also be based on the general winning points to stand a chance of success.
With regard to this OP and the protected rights of breastfeeding mother and the unlawful arbitary time discrimination not allowed. I have heard that sometimes the Lead Adjudicator can take months to look at a case again. So I would be inclined also to make a formal complaint now to London Councils for their breach of legal responsibilities as a service provider. This can then hopefully be escated to the Local Governments Obudsman.
I think time is of the essence here as PE won't waste any time to issue court papers.
I would press urgently for the landowner/agent to cancel this charge - be forceful with a view that should legal proceedings commence then a joint and several counterclaim will regretfully be issued against both parties.0 -

I received a 'Letter before County Court Claim' dated 3rd of Feb from Parking Eye demanding the £85 and provide a list of additional charges that would apply if they have to issue a CCC. Should I ignore it for now?
BTW, I did send another angry letter by Special delivery and marking as Urgent, Private and Confidential to Theresa Morris (CEO) of TJ Morris (Home bargains). I attached the previous letter and a copy of this 'Letter Before CCC' saying that if this was to go to court then, Home Bargains will also be dragged into this because they are equally in breach of the EA.0 -
No you should not ignore the LBCC - you need to read Daisy's thread and repsond robustly regarding the failings that PE's letter does not meet the criteria of Pre-Action Conduct and Practice Directions. You only have 14 days to respond - otherwise Parking Eye will issue court papers.
And do include in your response their failings to meet legal obligations with regardin the Equality Act.
