Hi all,

Need your expert advice on how I can avoid paying this PCN. I recently parked in the Wrexham Home bargains car park with ANPR. Apparently I was 12 minutes over the 2 hours free parking allowance. I have a 3 month old baby that got hungry while we were shopping, and feeding her slowed us down :( (not that Parking eye care). Fair enough, we were late in leaving the car park, but is there anything we can do to avoid the fine? The notice says that I will have to pay a fine of £85 and if paid within 14 days it will reduce to £50. With a little baby I don't have £50 to spare for a fine, let alone £85.

    You need first to make complaints to the retailer, tell them that they through their agents are in breach of the Equality Act 2010, as a mum feeding a baby is a protective characteristic under the act. Inform them that you require an adjustment to be made.

    Also make an appeal to parking eye along the same lines, also that you didn't see the signs, or that they have the authority to issue tickets. Or their financial loss is anywhere near what is demanded.

    Once they come back with a rejection, come back here with help with going to popla to get this cancelled, providing you are in England or Wales

    I am sorry to read of the problem described below. Unfortunately this car park is controlled by Parking Eye and we therefore have no control over the parking restrictions that have been put into place.

    In order to appeal your parking fine you will need to contact Parking Eye directly. You can either appeal by letter to:

    or on line at https://www.parkingeye.co.uk/appeal

    It is with deep regret that we have had to pass over the management of our XXXXXX car park to a third party. Customer feedback showed that people were struggling to find space, so we have passed on management of this car park to Parking Eye. We chose Parking Eye as our research shows a camera based system is much fairer than a warden walking around, as people get treated equal as it is in operation 24/7. It also provides us with data on car park usage which is how they (Parking Eye) determine the length of stay time. The charge imposed is also at their discretion and is in line with other charges within the town.

    We have not taken this decision lightly because as you rightly point out, we do not want to put off customer from visiting the store, but feedback from customers led us to this choice as customers are currently put off from visiting the store as the car park is always full, especially during the summer season. We spoke with other traders in the town who operate car parks and they have moved to the same or similar system, as they have also encountered the same problems. We do monitor customer feedback regularly and I would not hesitate to make changes should customer opinion change again and the majority feel that then new system is not working.

    As such the matter below would need to be addressed to the appeal process of Parking Eye

    Thank you for the quick response. When I ask them to make an adjustment, does this mean I am asking them to waive the fine or reduce them? Also, I doubt that the 'private' land is owned by Home Bargains. In which case, should I only be writing to Parking eye?

    Just in case I ignore the PCN and any reminders, what happens then?

    The adjustment would be cancelation of the ticket. If they don't own the car park, look for who does own it and complain there, this harassment you will get from parking eye is unlawful, and they as principle are equally liable for the actions of their agents.

    When you write to parking eye mention that the grace period is not sufficient as they have a 15 minute period in a lot of their car parks.

    I don't believe that HB own the car park as there are a number of retailers that are covered by that car park

    Hence the reason to find out who does, research there on google for the name of the car park, local council for planning, or simply asking the retailers who does own it, or their agents. Somebody has engaged parking eye , they don't turn up willy nilly ;)

    What? You DO NOT ignore Parking Eye as they take people to court and this is EASY to get quashed. Send a letter like this one in the Morrisons/Parking Eye thread:

    Post #15 shows the official Equality Act complaint I wrote for someone.

    Send a version as angry and detailed as that, with the same heading but tweaked to remove reference to Morrisons & changed to explain you were breastfeeding, to the CEO of Home Bargains, preferably snail mail marked on the envelope with his/her name and 'strictly private and confidential - addressee only'. Do not send it online to HB via any customer service generic link, waste of time.

    Send a copy of it online to Parking Eye as an attachment, stating in the appeal box that you challenge this PCN because you were breastfeeding a baby and it seems clear they have failed in their legal duty to make any reasonable adjustments under the Equality Act 2010. Say that you were a patron of Home Bargains and as such you are disgusted about this harassment and have sent the attached serious complaint to the CEO today as well and you expect to hear by return that this ticket has been cancelled. Also attach a copy of the Home Bargains Receipt to HB and to PE.

    This will be cancelled for you, of that I am certain, like it was on the Morrisons thread.

    Thank you very very much CM. This is awesome. Don't think Parking Eye will challenge that. They'd be daft to refuse my appeal :)

    I must admit, not very long ago, when I was heavily pregnant, I had one from TPS that I ignored and they stopped sending any reminders after about 3 months.
