  • I bet the finance director will work for another solicitor's firm soon, he'll find a way around the SRA punishment, there's always a way.

I notice that one of their websites is still up, wonder if a complaint to the SRA is in order?

From that it appears to be about something back as far 2008, it just shows though that there is a track record of wrong doing back 5 years. Shocking that they are allowed to trade. It fits in with roxburghe though
I believe that is incorrect. The local paper's report does the thing that papers do all too often and that is to print what are actually two separate stores next to each other and because they involve the same parties the inevitable occurs and that is the stories become mixed. I believe, therefore, that this is a second investigation although it may in some way be linked. That said, given the original investigation involved the disapperance of £1M and the firm was allowed to continue trading during the investigation one wonders why now, 5 years after the event, there is a greater necessity for the firm to be closed. Securing evidence and - potentially - missing cash is a bit pointless. The money has long gone and they've already had the firms books once so I can't see it being connected to the earlier matter.

In addition, "the firm" has gone through a number of changes during the course of the investigation in that it has gone from Geoffrey Parker Bourne, a firm, to Geoffrey Parker Bourne Ltd and then to GPB Solicitors LLP. I suspect that the closure involves the current incarnation i.e. GPB Solicitors LLP and is therefore reasonably current.

The transcript of the Solicitors Disciplinary tribunal hearing in respect of that earlier case (which also makes it clear that the "wrongdoing" involved a named member of staff who was not Daniel Clarke). That case also involved a forensic examination of the firm's books and would (or at least should) have identified who was responsible. There is no reference whatsoever to Mr Clarke in that write-up. The judgment - from the SDT website - may be read here (opens as a PDF).
My very sincere apologies for those hoping to request off-board assistance but I am now so inundated with requests that in order to do justice to those "already in the system" I am no longer accepting PM's and am unlikely to do so for the foreseeable future (August 2016). :(

Well I don't believe the SRA are that quick with anything, they appear to have been investigating Graham White for an eternity, and there appears nothing has happened yet.

Just skim read the judgment. Looks like 3 of the firm have been required to pay a fine/costs of £59,000 between them - wow!

Hope our Rachel has a deep and wide open purse - serious stuff.
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

But, "...that in light of the lack of financial resources of all three Defendants the costs ordered against them should not be enforced without leave of the Tribunal"

No resources! There are 75 members of staff! What? aren't they paying themselves?

Thanks HO87, the dangers of the 'skim read'.

Maybe we should all chip in and help these poor souls.
