Court Success Judgement against Small Planet Airlines

  • I sent a copy of my judgement via email to the company solicitor. Here is the copy of the letter:-

    Dear Sirs

    Following the ruling of District Judge Lusty at Hastings County Court on the 9th October 2013 I have a judgement against your company for £741.40 compensation under European Law for an extensive flight delay. I attach a copy of the judgement for your records. You will be aware of the same as I have considerable documentation from you in respect of the case.

    You have not paid as required by law and I make formal demand for the same.

    Full settlement should be made within 14 days to:-

    Dear Emptysuit,

    I refer to Your claim (No. A3YL69236) and Hastings County Court judgment regarding the flight delay No LLC347 performed on 27 September 27 on route Gatwick – Prevesa.

    Thank you for taking time to contact us. We are willing and ready to cooperate. In addition, we are keen to settle all the disputes in a peaceful manner.
    However, we want to know whether the amount of £741,40 was sentenced just for you as the only one Claimant or it was sentenced for more persons who travelled with you?

    It is good they are going to settle the claim in "a peaceful manner" - I hate it when you have to go to war to get your flight delay compensation. ;)

    doesn't make any difference to your claim if others have been paid out or rejected. Read Vauban's guide and issue NBA and start court proceedings if you believe you have a claim
  • Well done Emptysuit. I have today had an email from SP offering £50 each (4persons). I am somewhat surprised to get a reply after 3months of nothing but am disappointed with the offer. Presumably, I go back to them & reject it and for the full amount? I haven't had to go down the court route, just sent Martins template.

    You might have to issue Court proceedings if you want what is rightfully yours under the EC261 regs.

    Read Vaubans excellent guide then post any questions you have after reading it.

    greenchilli - I was on that flight too. I have decisions in my favour from both CAA and the Spanish equivalent, but still SPA refuse to settle. I am currently trying to find out if action can be taken in both Poland and Lithuania on my behalf, via the UK European Consumer Centre (contact passed to me by the CAB).

    Trying to stand firm on this...but it is taking way too long.

    Has anyone successfully claimed against Small Planet using one of the online claim companies? Which one did you use? I contacted Bott & Co on behalf of my mother but they don't deal with Small Planet as they do not have a UK address. Thankyou

    We must have been on the same flight as you in September 2012, delayed 17 hours in Gatwick.
    I have been pursuing a claim since November 2013, first through Olympic Holidays and now on the Small Planet claim form which they have sent me.
    The problem now is that they say the flight number (on the tickets and supporting documentation) is not valid. the flight number LLC347 . They are also asking for a Tourism Services Contract. This is not recognised by the European Commision form.
    Did you experience these problems? Help!:mad::mad:
  • If anyone is still following this one, I have recently received settlement funds from Small Planet!!!! Took 3 years but now worth the wait!
