Court Success Judgement against Small Planet Airlines

  • emptysuit - have you had any success pursuing smallplanet airlines?

    my wife and I suffered a 16hour delay flying from Manchester to Cofu back in 2012. Pursued claim through CAA, but in the end CAA said unable to assist as no response from small planet. was going to pursue a smallclaim against them, but cant find a UK address to serve summons.

    Any assistance from anyone would be appreciated.

    perhaps a solicitor would be interested in pursuing a class action claim?
  • Hi, I've just got back from Zante, booked through Olympic but the flight was with Smartwings. We should have flown on Sunday 14 September but due to a bird strike our flight didn't take off until 5.30am on Monday 15 September. The flight number was QS 3073 from Zante to Gatwick but I can't find any details of it on flightsats. Do you think we have a grounds for a claim? Any advice would be greatly appreciated. Also, despite asking repeatedly we have not been given anything in writing regarding the delay.

  • it was listed as a Smart Wings flight but we have received the following email from Olympic:

    Further to requests received flight delay letters have been posted to Mrs Neary, Mrs Wright and yourself. In relation to the EU ruling regarding flight delays it should be noted that it is specifically the Air Carrier, not the tour operator or travel agent, who may in certain circumstances be liable.

    Any and all claims must be submitted by the affected party to the airline in question. The address for the carrier follows:

    Small Planet Airlines
    Smolensko Str 10
    LT - 03201
    Vilnius
    Lithuania

    It is our obligation to direct clients to the airline referred to however, we cannot guarantee that clients will receive financial recourse as this depends on the nature of the claim and decisions taken by the airline.

    Should you wish to make a claim through your travel insurers you will require the letter which has been posted to you.

    Smart Wings is certainly not Small Planet, it seems Olympic Holidays get so many complaints about SPA they just send out a standard letter regarding delays without bothering to check!. Smart Wings is based in Prague and is a different kettle of fish altogether but if the bird strike was on the flight inbound to meet you, they may well claim extraordinary circumstances.
  • Just to update this thread. I successfully received settlement for the full amount of £743.41 compensation into my bank account this morning from SPA in Lithuania. Its taken a year of hard graft since last October but I am very pleased that justice has finally prevailed.

    Can I just ask you to confirm the last step(s) of your process to get the money, as I am (trying) to persue a claim of 19 hours for 7 people!
