Parking Charge Notice UPDATE #47

  • As I've got a 'rejection to cancel my ppc letter' from the centre management.
I am penning my second complaint. (Worth a shot, isn't it?)
Also in that letter from the centre, they have said if i wish to appeal here's the details for UKPC.
Do you think they have passed on my details to UKPC, or is this against the data protection act?

One minute you say it's UKPCS and another UKPC. Confusing!

I doubt the Centre has even mentioned your letter to the PPC, they have simply fobbed you off.

It's UKPC. Once it was written as UKPCS but this was a incorrect typo.

Just to clarify, I have only received a NtD, slapped on the windscreen

P.S. the centre is a Westfield centre, has anybody had experience with them?

OK so you re waiting a NTK then, from that joke of a firm, UKPC. This will be soooo easy to appeal and win. :)

Yes. I am waiting for a ntk. I like your confidence in saying they'll be easy to appeal and win.

I am also having another go at writing complaint number 2 to the retail centre management. My first one was too nice. And I'm still having difficulty in not being too nice. But on my second one I've added points such as the parking charge isn't a pre-estimate of losses.

And at this point I just want to say thanx to yourself and others who have posted to this thread.

Hi guys, I really feel like I've got myself in a pickle. (And sorry to sound like a broken record)
I wrote my first letter of complaint to the retail centre. And I think in my panicky state I have unintentionally identified myself as the driver.

    In the letter I wrote:
"Upon returning to our vehicle, I was deeply saddened to notice a ‘Notice to Driver’ applied to the windscreen."
This sentence implies myself as the driver. Do you agree?

So the retail centre replied, then I sent my second complaint, to the retail centre.

The retail centre have now passed on my details to UKPC, and UKPC have written a letter in response from the appeals dept.

Is the retail centre allowed to pass my details on to UKPC? Does this not break the Data Protection Act?

Also in the letter from UKPC they wrote, "If you do not have any further evidence or cannot assist us in any way as to justify the means by which you parked we cannot cancel this parking charge."

It has now been over 28 days since the ticket has been issued.

At this point, I am going through a lot of personal issues, and dealing with this ticket is adding extra stress.

  • Is this my chance to ask for a POPLA code?

Stop worrying about what the retailer might or might not have done, and the correspondence you are getting from UKPC is general template stuff.

What you do need to get is that POPLA code, so write back to UKPC and tell them you have already submitted your appeal, that they should either accept it and cancel the charge, or reject it and forward a POPLA verification code. Any further delay from them will result in you reporting this via a complaint to the BPA.
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

Stop worrying, just write back. Hopefully everything you need to know is now here so make sure you are more careful at POPLA stage:

However, your wording to the store where you said 'we' could equally have suggested you were the passenger - so reiterate to the PPC in your reply that you are the keeper and although you were in the car that day you have at no point identified the driver and will not do so. As you are the registered keeper you are entitled to appeal and to have a POPLA code, as such you expect it to be sent by return.
