Parking Charge Notice UPDATE #47
Comments

Ok thank you for your replies. As coupon mad has said. I will complain to the centre management.
Is there anything I need to make sure I address in the complaint? Also should I still refer to the driver in third person?
I'm sure I can cover the basic things.
Also, could I try and find out who is the land owner, and complain to them too, or is there no need for that.Save in 2013: #166: 9,122.51/[STRIKE]5,000[/STRIKE] 10,000Interest earned in 2014: £257.61 20/04/140 -
No need to find out who the landowner is, as long as you can find a contact at the Centre Management.
Complain to them and say that the driver on the day was a genuine customer (show copies of receipts if you have them) and that now you have seen this ticket you feel harassed over a minor matter which has put you off returning again. Say you are horrified that a third party like UKPC can be let loose in the car park to try to profit from customers for trivial transgressions like this, which was no fault of the driver's, due to the way other cars were parked.
Keep the driver in the third person.
By the way, you asked if UKPC ever do court? The answer is a resounding NO, except when they were taken there, twice that we know of, have a read of these threads about your bunch of chancers!

They have never ever been known to try court - and nor do ANY PPCs after we have helped people at POPLA - because the fake tickets are always cancelled by POPLA.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Ok thanx. I'm guessing its best to give the vehicle reg and pcn reference.
Sorry for sounding daft!
Will read some threads on here, now that I know what I'm actually doing!Save in 2013: #166: 9,122.51/[STRIKE]5,000[/STRIKE] 10,000Interest earned in 2014: £257.61 20/04/140 -
P.s. my reason for not parking within the bay lines was because it was a busy day, Saturday, virtually impossible to find a parking space. (Its a free car park)
So I parked on an area next to a grassy verge. (Like a lot of people do)
Will using the point that "finding a parking space is difficult" give me brownie points in the complaint?

Well in the complaint to the Managing agent do not word it like a begging appeal. You don't have to cover what you supposedly did 'wrong' because the whole flavour of the letter should be complaining about the shocking harassment of a customer, and asking them to step in and quash the ticket...please.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Just to clarify, I have only received a NtD, slapped on the windscreen
P.S. the centre is a Westfield centre, has anybody had experience with them?Save in 2013: #166: 9,122.51/[STRIKE]5,000[/STRIKE] 10,000Interest earned in 2014: £257.61 20/04/140 -
Right, today I received a letter, from the Westfield centre, in response to my complaint letter. They are clearly saying the driver is in the wrong.
Ok, I admit the driver is in the wrong.
So simple advice guys,
Simply pay up.
Or appeal to the ukpc.
ETA: I was parked on what they call a pedestrian area. Or a grassy verge or a pavement. Basically I had to drive over a high kerb to get on there.
P.s. I am totally thinking that the popla will also take ukpcs side.Save in 2013: #166: 9,122.51/[STRIKE]5,000[/STRIKE] 10,000Interest earned in 2014: £257.61 20/04/140 -

We're on post #39 and you're asking whether our advice is 'simply pay up'. If that was our advice this thread would have ended at post #2. What do you think our advice is likely to be?
If you're 'totally thinking that POPLA will also take the UKPCS side' then you've really not done any level of research on the forum. This is an essential element in ridding yourself of your problem.
In case you've missed it, all POPLA appeals assisted by this and PePiPoo forums in the past 7 months have been won. Yes, all of them, 100%. Why do you think we can't help you in the same way?
If you do no further research than this - read the following thread and decide what YOU then want to do.
https://forums.moneysavingexpert.com/discussion/4488337Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

Ok thank you guys for your recent comments.
Yes I am thinking "oh im in the wrong oh ill just pay!"
But tbh, I have done more reading, more so that got me was reading another thread, where op is in the same position as myself, and you guys are convincing them that popla will win.
It's like I'm seeing it from another level reading looking from the outside.
So I will stick to your advice (even if I think I have done wrong, the ppc can't enforce me to pay there stupid invoice - but seriously guys I have to show you a picture of how I was parked)Save in 2013: #166: 9,122.51/[STRIKE]5,000[/STRIKE] 10,000Interest earned in 2014: £257.61 20/04/140
