Parking Charge Notice UPDATE #47

  • Could I use something stupid as an excuse to appeal, to either UKPC or POPLA, for example, something they mention on the parking notice but not on the signs (which they claim is the terms and conditions), such as, the signs do not say there will be a 1.50 charge for paying by credit/debit card. Or something else I can nit pickk?

  • I've read on the parking notice that if the driver wishes to appeal this must be within 28 days. So I guess I haven't got time to wait for the NtK letter to arrive.
So I will start to pen my first appeal letter.

Do you mean you will start to pen your first COMPLAINT letter? Not an appeal at this stage, complaints. You're are wrong about trying to appeal now, stop reading the ticket and believing it! That time limit is for the DRIVER to appeal which we DO NOT RECOMMEND AT ALL. You will be appealing as the KEEPER, later, in Nov/December if you can't get it cancelled by complaints first.

  • Honest to god, I am actually losing sleep over this and stressing.
Despite all the advice from MSE, a part of me is still worried. A part of me would rather just pay the discounted rate of £35. This invoice from UKPC is actually just adding to the stress, that I don't need.
"Since the scheme started, POPLA's told us that it's had more than 14,700 cases brought to it. In 45% of these, it's found in favour of the motorist."

    45% isn't a great number.

Ok I say, I didn't follow the stupid UKPrats terms and conditions.

But now if I pay, it can all be over and done with. And I can continue with my already stressful life.

Sadly, paying £35 is a hell lot easier than paying £70, if I'm in the 55% of motorists who are not favoured by POPLA.

At this, time of year, I need all the pennies and time I can get.

You're nowhere near POPLA at this point, so deal with the 'now'. Get your complaints in and wait for the NtK.

POPLA is for another day. If you appeal to POPLA with forum help you will be one of the 45% (we have a 100% success rate); if you do it on your own in the panicky style you seem to be displaying, you will be one if the 55% - I'm 100% sure of that.
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

The is nothing stressful about this. You wont need to pay a penny as we always win at popla with the right wording

But If you can't follow simple advice pay up.

    I give up

Why are you stressing over this? We are telling you that we win 100% of the time with forum assisted appeals! You won't be paying anything if you follow the advice here so paying £0.00 is a lot easier than paying £35.00 or £70.00.

We have seen this thousands of times, you are seeing it once, read the popla decision thread, look at all those winning posts, this could be you with ukpc who have never done court and have been sent packing, and I don't say that just because it's my belief.

I say it because it's fact, take a look at this foi request
    https://www.whatdotheyknow.com/request/small_claims_from_bpa_aos_member#incoming-413891

This is the company you are dealing with
    http://nutsville.com/2013/03/31/british-parking-association-member-ukpc-in-epic-data-protection-failure/

And this what these jokers tried to do with Nutsville, utterly pathetic! And they saw right through it, and the article is obviously still there
    http://nutsville.com/2013/04/02/uk-parking-control-limited-threaten-nutsville-with-the-police-the-high-court-maybe-even-a-pig-in-a-basket/

Does this sound like a company that is anything but a joke?

We win 100% of the time. Every case helped on this forum since Easter, when we sussed what is needed in a POPLA appeal. :)

Wait for the Notice to Keeper - and try the complaint avenue first, which works too. Loads of successes reported in the sticky thread all about it which I only started in August. A customer can complain and get these fake ticket quashed just like that if you speak to the Manager.
