    It's nothing like it, at all. Shame on you.

    I did not compare kids theft to that of the dog. What I meant was that the word stolen and kidnapped mean the same.

    peachy, my advice is to step away from the thread, you may be right, but there are some on this thread who aren't interested in right and wrong, or in getting good advice.
    If you want to get lots of thanks, just agree with whatever hachette says, and don't ask questions.

    2. If you were in the other person's shoes, how would you react?

    Reply from DEFRA to my letter to PM.
    I don't know how well I manged to get this letter on here and if it readable.
    Bottom line is nobody can touch RCVS or negligent vet.

    I have read the papers you have sent me and I feel you may have a case to be resolved.

    I can provide a report in this matter and allow the matter to proceed to small claims.

    This is what you have paid me for and this is what i am currently instructed, by you, to do.

    I can also provide a service where I can contact the practice involved and negotiate a settlement with them to avoid court proceedings.

    I act in this manner as a single joint expert where both parties accept my version of events and my explanation and I work toward a settlement that both parties are satisfied with.


    If you are prepared for me to act as a negotiator in this matter- it will not add to your costs then please indicate if you would like to consider this as an avenue to consider.

    The above is recent e-mail I have received from my forensic vet.

    Is he being "professionally cautious" or has he doubts that you have a solid claim? If you did employ him as a negotiator, is the vet going to willingly pay his fee for this service, as I don't believe the fee you've paid him would cover these extra costs.

    Thank your for your e-mail. I did not expect to hear from you until sometime in November so was happy to hear so soon and to hear that you feel I have a case to be resolved. As you may know I have written to my ex-vet stating my claim and why (copy of my letter attached) the only reply I got was on their compliment slip saying my letter was passed on to their lawyer. I have no doubt that they intend to defend the case. However for me this is not about money but now it is the only way I can go forward to proof that what has been done to Maxie was wrong and it would be more justifying for me to go to court then just receiving their cheque. Of course everything depends on your expert opinion You say you would act a a negotiator in this matter with no extra cost to me but it would mean extra work for you. Would you be able to get some fee from them? Will I be able to see your report before you do any negotiations? The bottom line is yes I would consider the avenue your have suggested and see how it goes but will not back out from my claim should they reject it. More then happy to go to court.

    Could I make my final decision when I see your report?

    Yes, you can agree to see my report and then agree that I act as a negotiator. (
    or not)

    I will make contact with the other side to try and resolve this dispute, if they
    agree to this then i will request a fee of them as well. ( as a single joint
    expert)

    I will then look at their version of the events, compare it to yours and then
    write a single report and send it to both sides.

    Each side does not have to abide by my decision and each party is free to
    continue on to court and " fight it out"

    I have found that in this forensic work I do that courts are the last place for
    truth to be determined, they are sadly designed to elicit winners and the truth
    is a secondary by-product of winning.

    Even if the other side agree to pay a fee for your loss, these are usually
    bolted onto non disclosure agreements so you cant tell anyone you " won"


    So, for now I will write a report based on what you have provided, I will allow
    you to consider the report and I will then request permission after you have
    read the report to approach the other side.

    They may feel quite nervous if I approach them and it is common to send a
    solicitors reply when people really need to feel some sort of acknowledgement
    that a tragic or unfortunate mistake occurred and an apology would really help
    in this matter.


    I am glad that you are open to this suggestion and I will make contact with you
    around November 11, 2013.

    I employed him as forensic vet expert to do a report on all the clinical documents I had and I had them all. I checked him out he is registered forensic vet and more. If he thinks I have a case and I also think so well ...

    now he never stated you have a case did he. as what you stated in the previous post
