Do I write to the landowner, stating that the tenants- Aldi and Parking Eye, are imposing their own parking restrictions outside of planning permission, and request that they get the charge invalidated, and use the arguments discussed and also send a copy of the letter to parking eye, responding to their supposed charge and asking THEM to cancel it on those grounds?
YES - if you know who the landowner or managing agent for the retail park is then complain in writing too. It's not just about Planning permission though - your Equality Act point (disability discrimination, for which the Blue Badge scheme is irrelevant) is their fault as well because they are liable for their agent's unlawful actions.SlimmingSusan wrote: »Should I also ask PE for a popla code should they reject my appeal?
Yep, that's the normal way to end the first challenge, points the way forward 'either cancel this ticket or send me my POPLA code'.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Just wanted to thank everyone for the help you have given me, especiallt coupon-mad.
It had taken me all day to focus, but have written to GVA manchester, the landowners, and also Parking Eye, heading that one challenge against...
I did the planning consent and the Equality Act angle, as advised.
Will update when I hear anything.
I really wasn't aware of the equality act thing, need to look into that, thanks so much for the information.:D
It has actually made me feel quite empowered, when I was feeling powerless and overwhelmed by it all, little steps....0 -
I sent a letter well within the time limits, mentioning that the planning permission was for 3 hours and blah blah, both to the land owners and the parking people. I also mentioned my chronic diagnosed MH problems and threw in the Equality Act 2010 as advised on here.
I have had a letter from PE saying they are reviewing the situation, just those words.
Is this good or bad please?0 -
Really, just:
"Dear Slimming Susan
We are reviewing the situation
With Love from
PE"
??
Sorry, I am not being sarky it's just that I have never known PE write a short letter when a long and misleading one will do!I'm a retired employment solicitor. Hopefully some of my comments might be useful, but they are only my opinion and not intended as legal advice.0 -
The exact 3 lines read:
Thank you for your correspondence in relation to your parking charge incurred on ** September 2013. at *** on Corporation Street Car Park,
We are currently reviewing the matter and will contact you shortly.
No signature, just yours faithfully, big space, parking eye team0 -
Interesting.
Maybe you have come up with something that has stymied them!
Keep us posted, and in the meantime don't worry, either way you are not paying anything!

I have received a rejection of appeal with a Popla code today from these bullies.
Were it not for the fact I buried my Dad's ashes yesterday, my head may be clearer.
It is a 9 sided letter.
I think I could get them on the equality act alone, but they seem to have some standard diatribe about people with blue badges, which I do not have, but I am diagnosed with chronic mental health condition, of which I can supply evidence. They are saying I have not provided sufficient evidence to show that I did not break the t&cs on the signage. I went and read them today, and it does say only shopping on the complex, but I did leave,as I have seen many people do.
Where do I go from here0 -

I promised to write your appeal for you and I will - you'll have it by the end of the week. I'll also send you some interesting info about the managing agents which may help you get it cancelled that route but it will be via PM tomorrow.0 -
First, you ignore the PE diatribe which is intended to intimidate you, so don't let it.
Second you pour your self a glass of your favourite tipple, toast your dad, and forget about this stuff until tomorrow.
Edit: ignore the rest of this post - just read Hovite's post above mine :-)
Then you read the last few pages of the POPLA decisions thread (top of page one of the fourm) and other links that forumites will give you. Get an idea of what wins at POPLA (hint: look for 'no contract' and 'genuine pre-estimate of loss).
Then you prepare a first draft appeal based on the examples you will find on the forum, and post it here for the regulars to check (don't go it alone, these guys really know what they are doing and win 100% of the time at POPLA).
Keep an eye on the time limit as you lose your right of appeal if the code times out.

Thanks Hovite, my head hurts and canot think straight, if you need any more info please ask.
Will be much clearer in the morning after some sleep, but also have my DSA assessment in the morning, maybe that will be pertinent to mention. I will be back on here late tomorrow afternoon ad really appreciate your help.
Am also here for a bit now but not very coherent.
Thanks LazyDazy also.
The neuropsychology lecture this afternoon also has not helped, but can I add that I almost broke down and did not attend my lectures today directly because of this letter,0
