    However I wouldnt simply give up because I don't want go to court. It's Very informal and not something to worry about.

    Search the forum for the keyword 'Gladstones' and send a 'put up or shut up' response as suggested to the others. This forum works best for you when you search.

  • Just a quick update! After doing a lot of research I completed and filed my skeleton defence on 28th November 2013. I have not heard anything since then. I have checked on the County Court website and also emailed them to check on progress but not heard anything back.
    I have received an Email off BPA stating they have told PCN NW to cancel my ticket but they stated the have left BPA and therefore they are no longer able to do Nything further with regards to my complaint.
    I also forwarded the copy to the DVLA who said they will look into it but felt like I was more of a fob off.

    I HOPE that is the end, as the court says they had 28 days to reply to my defence and I can't see they have done that but hopefully that is the end of it.

    Keep the email from their Trade Body (BPA) which told their member to cancel a ticket which was issued while they were BPA AOS members. Very useful if they do then proceed to court, which they could do later on if they pay a fee. Doubt it, but keep all the paperwork too.

    Oh my god, this never seems to end.

    Today I have received my 'Notice of Proposed Allocation to the Small Claims Track' :-(

    This was issued on 27th Feb, Shen I filed my defence in November 2013!

    Is it worth stating that I am happy to do the mediation and see if they will come to a compromise or shall I just tick the go to court box?

    Any advice appreciated.

    This is exactly the reaction they are trying for, to put the frighteners on. Its up to you if you wish to proceed forward. others will advise for sure.

    The mediation is offered for free by the courts.

    Whilst there is no duty to mediate, it would probably be best to do so as it shows reasonableness of the party. This isn't important for the case as a whole, but the judge can make reference to it when deciding costs. If you refuse to even attempt to mediate then the court may ask you to justify your reasoning.

    Thanks da-rule, I read up on that, seems an identical situation. I too thought it can only go for me if I show my willingness to at least discuss this with them.
  • You are under no duty to go to mediation.
    Da rule is wrong on the issue of cosrs with regards to mediation.
    Whats the point on mediating when you owe nothing. Ut has no bearing on your case
