PCN (NW) Court Claim Issued

Yet another court claim issued by PCN (NW) Ltd for parking tickets from November 2012. Sequence of events:
Parking Enforcement Notice issued 7/11/12 on windscreen
Parking Charge Notice to RK dated 4/3/13
Letter from Roxburghe Debt Collectors dated 8/4/13
Letter from Graham White Solicitors dated 19/4/13
Letter from Roxburghe Debt Collectors dated 2/5/13 saying referred back to them
Letter before Claim received from gpb solicitors dated 29/7/13
Court papers received 27/9/13
From reading other threads I believe we need to acknowledge the court papers with MCOL (I have already checked they are valid) & say going to defend to get time extended to 28 days?
Also write to the BPA as Parking Charge Notice is non-compliant?
Any further help or advice gratefully received thanks!

You are not alone! On this forum alone it's the same as all these cases (see the links on here):

Yep you have to acknowledge to get time to put in a skeleton defence within 28 days.
And look into what the PPC have done wrong in terms of that very late NTK and wording of letters, the LBC, etc. Read the other threads as zzzLazyDaisy has posted examples of complaint letters to send alongside the defence being submitted. The BPA and/or DVLA could influence this PPC to withdraw these cases as they are alleging keeper liability where they have failed to even jump through the most basic hoops to establish it under the POFA.PRIVATE 'PCN'? Is anyone else having problems sending emails to Elizabeth Symonds at DVLA as mine keep getting returned? Think she may have a full inbox!!0

It's Symons, not Symonds. I got a prompt reply from her.0

Quick Update - just thought we had got home & dry with our 28 days from filing our defence when today we have received a letter from Gladstones Solicitors saying that they are now acting instead of GPB Solicitors who have stopped trading. They note that a defence has been filed & say they will be proceeding with the case. Has anyone else had this?0

Hi, I received the same letter yesterday.0

Standard intimidation letter by the sound of it. You could reply and rattle their cage as to how strong your defence is, and reiterate why their client has no case and as such, if they proceed you will have no hesitation in claiming your costs at £18 per hour (Court rate) because their client has been wholly unreasonable and non-compliant with industry regulations. Sometimes it helps to make your case more of a 'hot potato' than one where the defendant is silent; you could even start the letter in such a way that makes it obvious you know why GPB have been 'removed' and that they should think twice about picking up GPB's dirty work because any failings on Gladstone's part in this sorry affair will result in an official complaint to the SRA.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

I've had the same letter today0

Can anyone advise how long it will be before we officially know whether they are pursuing this or not? The 28 days from my defence ran out on 11th/12th November and we received a letter from Gladstones dated 11th saying they are not acting as solicitors and intend to pursue it. If I log on to MCOL it still showing status as us having submitted a defence in September. Does this get updated & if so when? Was hoping they had missed the boat for us. Any advise on how I can find out for sure or how long it likely to be before I hear would be appreciated thanks.0

In your shoes we often suggest to ring the court and see whether the PPC has missed the boat, then you will know. Be aware they could always resurrect the case later but if it has been stayed due to not paying the next fee, then the PPC would have to pay again...
Search the forum for the keyword 'stayed' as this has been discussed only today and this week on a thread or two.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
