GPB Northampton county court letter

Hi posted almost a year ago now about a parking fine I received and was told to ignore it. I've received the odd few letters threatening me until today in which I received a court letter with a claim form from GPB telling me I have 14 days to respond and they want a hearing a Northampton County Court. I feel under pressure

What do I do thanks ??

    Unfortunately you were one of the first people to get a PCN after the law changed in October 2012. The advice then was still to ignore, but that has not been the case for six months or more. GPB have only just started issuing claims in the past few weeks, and it looks like they are trawling back through their stash of ignorers.

    First, you must not ignore this. Go to MCOL and file an acknowledgment of service and a request for time to defend. This extends your time for defending to 28 days.

    I am signing off for the night now but I am sure someone will be along soon to advise you what to do from here.

    Edit - just had a quick look at your other thread when you say you got the ticket, do you mean your auntie as registered keeper, or did she subsequently name you are the driver?

    Also, can you tell us
    the date of the parking event
    was it a windscreen ticket or a 'caught on camera' PCN through the post.
    What date was on the first notice received through the post by the RK (should hve informed her of her right of appeal)

    Thank you Daisy, I have filled in the Acknowledgement of service what would be the steps to take onward from here as I am assuming that I shouldn't pay the requested amount (£236.02)

    Sorry Daisy it was the first thread I created not that one, and it was on 9th Nov 12. It was a windscreen ticket and I'm not too sure about the first notice I may need to check that one up thanks.

    You need to write a skeleton defence to submit, so read the links from here:

    Should help you get your head around it if you follow the links and open some tabs to read up on defences people have used, discussions about PPCs issuing small claims and what to do and by when. Also here is a copy of a typical 'Letter before Claim' attempt issued by GPB in August over a PCN (NW) case like yours:

    zzzLazyDaisy will tell you (no doubt) that is not a compliant LBC (if you got one like that?!) and so you can also argue on top of your defence points, that the 'solicitors' who should know better are sending out template letters which failed to adhere to the Practice Direction, so as an individual who had a right to be properly informed, pre-Court, by a solicitor employed by a large firm, you invite the court to strike the case out.

    Hi, just had a quick look at your old thread (apologies for the earlier confusion!).

    Some points that may help - the PCN is called an 'enforcement notice' which is a breach of BPA CoP (Coupon pointed that out on your original thread but it may not have meant much to you at the time).

    Unfortunately there is no follow up copy of the Notice to Keeper that you would have got through the post. It is really important that you find that since, if it was served out of time - and there is a good possibility of this - they lose the right to pursue the RK in court.

    A robust COMPLAINT to Steve Clark of BPA could see this off for you, so do please have a good look for the NTK.

    If you really can't find it, come back and I'll help you to make a request for documents to GPB.

    Also, did you get/have you found the Letter Before Claim (you should have received one from the solicitor probably not long before you got the court claim)

  • Once again appreciate the replies

    I've been looking around and I've only come up with two letters from Roxburghe Debt Collectors one from March and the other from April asking for £160 I remember getting the letter before claim but cannot seem to find that at this moment in time. Would this leave me in a lesser situation ?

    I would bet my house on you not having a notice of claim, you would have received the standard letter from Graham White talking about £207.25p , have a look for the letter and it will come up with this

    When posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. They DO monitor the forum.
    We don't need the following to help you.
    Name, Address, PCN Number, Exact Date Of Incident, Date On Invoice, Reg Number, Vehicle Picture, The Time You Entered & Left Car Park, Or The Amount of Time You Overstayed.

  • I'm not too sure if I have that letter I'm going to try searching to see if I have any others but for now all I have are the two debt collector letters the second of which mentions the Graham and White solicitors and the court letter with response pack etc.

    I intend on ringing on Monday to see if it is real but for now I am worried on how to make a defense without some of the letters they have sent me :/

    You need to acknowledge the claim first which extends the 14 days to 28. That's all covered in the links leading from the one I gave you to help write the skeleton defence. Sit down and follow the links even if it means you have 12 tabs open at once!

    Do you think you never got a Notice to Keeper (first letter to keeper, after the windscreen ticket, usually from the PPC themselves not a debt collector)?

  • I've done the acknowledgement part and yes I'll go through all the links and try follow them to get a good idea of what I'm doing.

    I'm sure I did but I'm not too sure I kept it thinking at the time that it wouldn't come to this stage I guess

    Lets take this one step at a time, do not write to Mr Clark of the BPA because they are made up of all the PPc's who subscribe to them....

    You stated that you have received Northampton County Court Documents and that GPB have given you 14 days to respond....Thats B.S.

    It is not for GPB to give you anything, it is done by the Court Bulk Centre, so as advised, you need to contact Northampton County Court and check first that it is a real and Live claim......Also tell them that GPB want a hearing there as you stated, because they dont do hearings pmsl

    You need to post up these documents taking out your identifiable details....

    There have been an influx lately of PPC Trolls saying they have received bona fide court documents when in fact its all to gather info on forums
