    You should check the court papers you received which explain the rules about 'service' which adds a few days to the date they were sent to you. You count 28 days from the date of 'service'.

    Thank You also the defense I received from the other forum you linked me to was given by a senior member although I am slightly unsure on how to edit it, I asked for a bit of guidance but received no response unfortunately.

    I'm not too familiar with all the terms used in law which makes it slightly difficult when trying to edit i. Is there anywhere specific I can get help Thank You

    TBH I would write your defence in your own words, not try to edit a legalese version.

    Learn from the legal version and extract stuff from it about there being no pre-estimate of any loss, unenforceable penalty, and any other points, with case law as per your legal version BUT ONLY IF YOU UNDERSTAND IT. You are the person who, if this goes to a hearing, needs to know your own defence points inside out.

    I would just write it in your style but with the same sort of hard-hitting stuff that you see in most strong POPLA appeals or other small claims cases on here. The arguments are similar but was your incident pre-POFA (Oct 2012) and have you ever said who was driving or not?

    Yeah I understand and agree that it probably is the best way although the defense I was given mentioned that it would allow for the hearing to take place without me being in attendance which would mean the judge would have to actually read the full defense in substitute (This is what i was told by the other legalese). But I think I will only allow for parts I can understand which would give me peace of mind I guess.

    As for who was driving I haven't mentioned that at all and the event was post October 2012 thank you, appreciated

    So imagine that the judge is NOT familiar with POFA 2012 and you would need to spell out where the breaches lie, as with the code of practice breaches.
