Lied to about iPhone availability, where do I stand?

  • Actually, I always buy brand new cars but never choose the colour. Last one I bought I wanted dark grey, but there weren't any in the country. The dealer had a navy one in exactly the right spec there, and I negotiated 25% off list price, chose my reg plate and picked it up a few days later. 2 years later I couldn't care less that it's navy and not grey because it really, really, really doesn't matter.

    Why do they bother doing different colours I wonder.

    Just a cockup by the salesman really, a different colour doesn't make the product any different.

    Not sure that they lied to you either, it's not as if they were offering a gold one which turned out to be grey.
  • As a previous branch manager for O2 you could complain to Three but it won't get you anywhere. There could be mitigating circumstances as to why they said that - miscommunication, new employee etc.
    They could have also just been trying to make a sale to boost their figures. However, they could have done you a favour by giving you a handset you wanted to resolve your need for the latest technology.

    What gets me most is the time you have taken to post this trivial matter up on this forum. I think you need to take a step back and think about what better things you could be doing with your life...

    Your only redress could be a possible breach of of Schedule 1 Regulations 5 and 6 of the Consumer Protection from Unfair Trading Regulations 2008, which state that the following are unfair commercial practices in all circumstances:
    5. Making an invitation to purchase products at a specified price without disclosing the existence of any reasonable grounds the trader may have for believing that he will not be able to offer for supply, or to procure another trader to supply, those products or equivalent products at that price for a period that is, and in quantities that are, reasonable having regard to the product, the scale of advertising of the product and the price offered (bait advertising).

    6. Making an invitation to purchase products at a specified price and then—
    (a) refusing to show the advertised item to consumers,
    (b) refusing to take orders for it or deliver it within a reasonable time, or
    (c) demonstrating a defective sample of it,
    with the intention of promoting a different product (bait and switch).
    However, I think you'd have a hard time proving this. Just buy it from Apple anyway, as it will cost you less overall. See this thread to understand why.

    You have no idea what I do with my life. For your information, I posted that while rocking my baby son to sleep while my wife slept in after the late shift. Not that it matters. Maybe you should take a step back and look at your life and think about how you should make presumptions about others? If it was so ridiculous for me to spend my time asking the question it was more ridiculous of you answering it, and spending more time telling me so. Anyway apart from the few decent responses, this has basically shown me that a lot of people aren't friendly money savers here, more just looking to attack the newbies with snide, uneducated remarks surrounded in personal opinion.

    I agree. There's a lot of hype about the gold colour and it's in huge demand, but the front of it is white which totally spoils the gold effect. If the front had been gold as well, I would have got it, but I bought a black/grey one instead.

    Agreed Can't understand why people are so fussed about the Gold especially as it won't be long until you can buy the back off Ebay.
