Buyer returned my phone incomplete

    They gave me no reason why they wanted to send the phone back, other than "they have no interest in a chinese phone" - its a HTC sim free, direct fron HTC.

  • Is a case open for SNAD? If so and the buyer has sent it back tracked, they will get a refund, whether you choose to do it yourself or not and it will be from your funds.

    If you are a business, you cannot legally withhold the refund.

    If and when the case is closed in the buyers favour you can appeal it and add a photo, but its not a forgone conclusion that you will win on appeal.

    No its not SNAD it is 100% accurately described, with photos, they sent it tracked i am the only person to open the case.

    Like i said, the only reason they gave to want to return it is "It is chinese" and then they said they will report it as a fake chinese phone. I'm private seller.

    What if i win? Do i get to keep the phone and their payment? And do they get a refund off ebay anyway even if i do not refund and i win?

    I didn't ask if it was SNAD, I asked if a case was open for SNAD, a completely different thing in eBays eyes!

    IMHO you will not win the SNAD. You can try an appeal, but that's not weighted in your favour, as it isn't a lot of damage, despite what you think.

    Well, you may be able to placate the buyer. But be warned if you don't satisfy then, you might force them to open a dispute.
