Buyer returned my phone incomplete

    Can you PROVE that the cardboard bit was there when you sent it?

    If not and you the buyer can prove they sent it back then I'm pretty sure ebay will force the refund.

    If you try to resist then the buyer will just say that bit was not there and if you cant prove it was then ebay will find in the buyers favour.

    Has the missing piece caused any damage to the phone?

    If not then save yourself the hassle and refund. You have the physical goods back, there is no set of circumstances that based on a piece of cardboard that you will be allowed to keep the phone and the buyers money!

    You may have got off lightly, you didn 't receive a rotting banana in a box or other scam, for example.

    actually the back of the phone has a mark/slight dent that was not there before, due to poor packing by the buyer who sent it back (the cardboard not inserted to seperate items from the handset) - so i think i will not refund at all.

    I can no longer sell this phone as grade A mint condition.

    If you're the seller, and the buyer opened the case, you won't be able to close it, your only options will be to respond to the case, or ask the buyer to return it for a refund (which presumably you've already done), or issue a refund.

    The only way for you to close the case is to issue the refund.

    I imagine if you don't issue the refund, the buyer will escalate the case to eBay for a decision, and they will refund the buyer on your behalf.

    If they don't escalate, the case will eventually time out after about a month, I think.

    I opened the case, buyer wants immediate refund or said they will leave negative, and report the phone as a fake to ebay.

    I had a mint condition smartphone, which now will have to be degraded to a B coz of a slight dent/mark on the back of the phone.

    Not a chane i will give a full refund on this.

    well thats new information to us. The cause may be the missing cardboard but the actual problem is the damage to the phone, this damage is what you will need to prove was not their when the buyer received it. The damage to the phone is what you need to focus on as the cardboard thing missing sounds trivial.

    I don't mind, i am in the right. Item is de-valued, what do you expect me to do? Say ok thats fine don't worry heres a full refund, i don't mind you are complelley careless and have no reason to send the phone back, sure i will take the finance hit for you for free?

    OK i have took a photo of it thanks. Also buyer had no excuse top send phone back, only said it was a chinese fake. It was described with photos mint condition.
