  • She loves fruit, although have no bananas in atm! Will get some next time i'm near a shop (bought everything but bananas yesterday, typical!)

    Just had my dad on the phone again telling me he has someone in there to clean up as best as she can, also that everything needs replacing. I am asking for pictures before anything happens but also i'm hoping to save the carpet with a good deep clean (or two) we'll see though :( Roll on tomorrow, it has to be better than today, surely!

    Just had my dad on the phone again telling me he has someone in there to clean up as best as she can, also that everything needs replacing.     Please STOP your Dad straight away! This is an emergency - the tenancy has NOT yet ended - you could find yourself in deep stinking ordure unless Dad and his helper get out of the house - without making any changes to it - immediately!

    You are the person who will be held legally responsible for an illegal eviction - if Dad carries on, there's a fair chance your tomorrow will not be better than today!

    He's out, I spoke to the lady that actually got the locks changed and she was apparently down there collecting rent for him and she thought someone had broken in to the house :( (does it ever end?) and this is why she suggested the locks be changed now rather than later. I only had half the story from him ( and he wasn't there as he'd told me :mad:) so I rang her to find out everything. Apparently the house has none of her belongings in anyway, well unless she was planning on coming back for an old rabbit hutch? So am unsure if she will even turn up. Anyway I will email her later and tell her what has happened and have asked the lady that works for my dad to meet her to let her in (and if she really wants...a key until the 24th) I can't think of any other way to make this better. The carpets that were brand new have had squares cut out of them too, as well as covered in straw, hay, urine and goodness knows what else. I am not sure how she was planning on cleaning all that in one afternoon? But have told them not to touch anything until she turns up and have asked that the tenant be walked around and a list be made of what needs doing (as has happened to me everytime I have moved out of somewhere) I have pictures of before she moved in so can compare. Can you imagine if i'd got squatters in as well as being owed money already from the tenant. *sigh!* I'm sure they would have had a look round and gone, nah let's try elsewhere though from the sounds of it!!!

    Thinking that if it's already too late for Dad and Cleaner to retreat with no changes, then your only way out is to end the tenancy.

    If you were to offer Tenant a deal; rent arrears wiped out in exchange for her collecting anything else she wants from the house and giving back the keys today - would she go for it?

    If she's savvy and realises your agent [Dad] has been inside her house without notice / permission, you may also have to offer to return her deposit - worth it to get her signature on some kind of document ending the tenancy.

    If she's not savvy then you are very lucky!

    Am far from being an experienced landlord, but know what's happening here is big trouble.. :(
  • This seems ridiculous to me that I give her a perfectly good clean, sound house and she destroys it by keeping pets inside, and is 3 months late paying me that I could be in the wrong by having someone clean out some straw in the bedroom. I'm sure you're right in what you say as you're clearly more savvy than me but I am so angry right now that I'm not hearing it :( I've done f**k all wrong really aside from being a flipping push over. Where the F**K are my rigths :( grrr it's so annoying that landlords are treated this way.

    I've had an email from the letting agent i have lined up funny enough replying to one of my messages the other day, he has told me I have the right to go in if she's clearly vacated the property and I can change the locks? Is he wrong then? I really can't do much now aside from ask them to throw some straw around and make it look more like her 'home' and have had enough am so close just to sending the keys back to the mortgage company *grr*

    I've no idea will have to ask her again but from the sounds of it yes it was. It's not the greatest estate and has happened before when empty so it doesn't surprise me.

    yes a complete and utter nightmare! I should have just let her come get her stuff (not sure what she was planning on taking?) and kept the keys and that be the end of it.

    She's not a professional agent, no, she works for my dad at his business and also does this (collect rent) as part of one of her jobs. Tenant has emailed me with a list of jobs that needed doing (some I knew about) and one of them was - a dodgy front door lock. So am guessing this is why it was broken as it sounds as though she left it in not much of a better condition?!

    I would almost be advising you go to CAB and ask them the best way forward with this. Or give the DPS a call to find out if they have any advice,

    She could take you to court as tenants have a right to live in their own home undisturbed.
