potentially naked bridesmaids at a wedding in two weeks - non delivery of dresses!

As an update, I emailed the seller last night outlining the complaints and saying that as I didn't think there was time to correct the errors before the wedding I'd like my money back (and I would return the dresses).
After weeks of radio silence and regularly not having my emails answered... I got an email within 20 minutes saying the dresses were perfect and there were no faults so there'd be no refund! :eek: If this is what the seller thinks is perfect I would be interested to see what she dresses like every day!
Anyway, I fired off another email late last night highlighting a few of the major issues and stating again I wanted a refund so we'll see what happens.
I'm outside of the 45 day window for Paypal so I don't think that's an option. My debit card is linked to my Paypal account, do you know if I could do a chargeback or anything or would I be better off going through small claims? (part of me wants to do this to teach her a lesson which is childish and I shouldn't think like that).
I'll let everyone know if anything happens today but I'm not holding my breath :rotfl:

So, my sister found some dresses she liked, we ordered them on Thursday to be delivered special delivery and they arrived on Friday.
Both me and the other bridesmaid have now tried them on and they fit and the accessories bought to go with the original dresses still work :beer:
Now for the annoying news...
I wrote an email to the woman who made the dresses the same day they were delivered, in it I explained the points I mentioned before and said that as we were so close to the wedding I didn't think she'd have time to fix the faults so asked for a refund.
Less than 20 minutes later I got a reply. Amazing how quick she can be when she wants to be! :mad: The reply (in full) was:
"Hi Karen, sorry but I do not accept there to be any fault with your dresses and as they are made to order a refund is not possible."
I slept on it and fired off another email that morning that said:
"Thank you for your quick reply.
Under the Supply of Goods and Services act 1982 I am entitled to a refund or replacement of goods if the product is not fit for purpose which I do not believe they are. As I do not believe you would be able to correct the errors we have noted before the wedding date (X September) I require a refund at this time.
Regarding the problems previously noted, I would like to draw your attention in particular to the discrepancies between the number of pleats in the front of each dress, the differing appliqu! and the poor hemming on each dress. If you require further photographs or require the dresses returned for examination then please let me know.
If you still disagree that there is any fault with the dresses may I suggest we engage the services of an independent expert to examine each dress.
As stated previously, I require a full refund of £190 by 25th September as we are unable to use these dresses for my sister's wedding and would appreciate a quick resolution of this issue."
This time it took her a couple of hours to reply.. still a damn sight quicker than she was when we were trying to find out what had happened to the dresses in the first place, saying:
"Hi Karen, As I stated in my previous email the dresses are not faulty and therefore you are not entittled to a refund (please refer to website terms and conditions). I would however be prepared to list the dresses for sale on my 'ready made' page and once they are sold transfer the funds to you. If this is acceptable to you please return unworn to the address provided on my website."
I haven't replied yet. I don't think that's a suitable solution because no-one is a) going to have the exact measurements as we do and the dresses were custom made b) they're really shoddy and even from photographs you can tell that and c) I just want the money back without any hassle.
Now I've made initial contact and expresses dissatisfaction I've got a bit more time but I think what I might do is collect the dresses from my sister next week so I've got them with me and then write a postal letter to her outlining stuff again and asking for a refund once more. If that doesn't work then I'll say I might take further action and I'll think about small claims court. It's only(!!) a couple of hundred quid but nearly wrecking my sister's wedding is not on and I would hate for her to do this to anyone else.0 -
I'd just sue her at this point. Send a letter before action, then if no refund is forthcoming, file a claim.One important thing to remember is that when you get to the end of this sentence, you'll realise it's just my sig.0

Same, OP, you won't get any further...scare her with a letter before action and she may just cough up!Don't trust a forum for advice. Get proper paid advice. Any advice given should always be checked0 -

I think she knew what she was doing by not delivering until after the Paypal refund date.
It's quite reassuring to know that I'm not the only one that thinks she might have been that devious and conniving.
I think I'll spend some time tomorrow finding a number or sensible email address for paypal so I can talk to someone and explain and see if I can get anywhere that way.
At least my sister is now happy with what we're wearing and it fits and doesn't look like a dogs dinner!0 -
