Just got this from Mr Lender,

More of the same, ignoring my offer.

Thank you for your email and income and expenditure. Your account has been passed over myself for further review.
My name is Michael and I work in the Repayment Plan department at Mr Lender. My role is to provide advice and support to our customers who may be experiencing financial hardship. We would like to work with you in order to alleviate some of the pressures you may be experiencing as a result of your current financial situation. We understand you are in financial difficulty and we would like to put you in a repayment plan to make things easier for you. However we are unable to accept your payment offer of £16.00 per month. This means you can still pay us £16.00 per month but unfortunately it will not be enough to set you up in a repayment plan and freeze your account.
Your outstanding balance is currently £710.00. We wanted to offer you the following additional help in order to close your account with us.
We wanted to offer you the following option:
Place you in a repayment plan for £600.00 (giving you a £110.00 discount.) We will freeze your balance and stop any further charges or interest from being added. The minimum we can accept is £30.00 per month. If this is not manageable for you, we suggest contacting a free debt management company such as Stepchange. They are a free counselling organisation. If they choose to act on your behalf they will place you in a debt management plan. Therefore whilst we are unable to accept £16.00 per month working directly with you, we may accept a smaller amount if you were in a debt management plan.
In order for us to set up your repayment plan, freeze your account and work directly with yourself, you will need to make your first payment of £30.00 today. If this is not possible, please let us know what date you can make your first payment of £30.00 on.
On what date would you like to make your other payments and please confirm we have your correct card details ending in xxxx. If you have a new card please fill in the below:
16 digit card no:
Start date:
Expiry date:
Last 3 digits on back of card:
Alternatively as stated by yourself, if you prefer to pay by bank transfer, please find our bank details below. When making payment please provide your reference number below:

Bank: Barclays
Account No: 23824616
Sort Code: 20 95 61
Reference No:

Should you require any further assistance please do not hesitate to contact us
As soon as we receive your response, depending on whether you can pay £30.00 per month we shall arrange for your repayment plan to be set up. Please be advised payment would need to be made today in order for us to action this. If this is not possible please let us know when you can make your first payment. Please note while your account is not in a repayment plan or a debt management plan, your account is still open to incur further charges and interest.
Please also see the link below where you will find a number of free debt counselling organisations who can help you, but we would strongly recommend contacting Stepchange if £30.00 is not affordable for you and enquire about a debt management plan.
Should you require any further assistance please do not hesitate to contact us.

Kind Regards,

Contacting Stepchange may not be such a bad idea, if they keep persisting in being difficult and basically ignoring your requests.

However, I think I would reply telling him that you'd be providing the exact same income and expenditure information to Stepchange, so why does it matter if the offer comes directly from you or from Stepchange?

I'd also point out that if you can't afford £30 per month, no judge would force you to pay that if a CCJ was made, so they might as well accept your offer in any event.
What will your verse be?

Thanks Mattye,

You are absolutely right. The amount will not change with Stepchange. They clearly don't like dealing with people who are self managing.

I heard they don't want the risk of their credit agreements, practices, and extortionate interest rates challenged in court, so these things rarely get to court. At the end of the day, the judge as you say will make me pay only what I can afford, which is what I have offered all along.

Exactly. I suspect if you told them to accept £16 because that's all you can afford, or take you to court, they'll accept the £16.

Usually that tells them you won't budge.

Respond with this..

"Dear Michael

Thank you for your e-mail and proposed repayment plan. I do not accept this.

Your suggestion to contact Stepchange does not make sense to me. Stepchange would make you a repayment offer based on the same information that I have provided to you, so I do not see why you cannot accept my repayment proposal based on the information I have provided already.

We seem to be going around in circles. I cannot afford to pay you any more than £16 per month, as you can see from my income and expenditure form. I therefore leave you with two options: -

1. Accept my repayment proposal.
2. Take me to court if you think a county court judge will order me to pay more, armed with the same information.

My offer is not up for discussion. I simply cannot pay money I do not have.

Please reconsider the position and respond accordingly.

Kind Regards"

If you look back at post 53 on this thread, you will see how they said the minimum they would accept from me a month was £118. Now they have gone down to £30!

Exactly. There isn't a minimum..these people are paid to convince you to pay more money.
