I'd be breathing a massive sigh of relief about the subsidence issue; it's a huge hurdle to have passed.
You haven't said what this 25 year old piece of paper is, but I'd advise either finding it or your solicitor explaining why it isn't needed.
It sounds like you're very close to exchange now - your buyer does not need to be in the country to exchange contracts. It's not easy, but you must try to be calm and understand that you've moved forward, you're close to the end and that you are not doing yourself any favours by over thinking everything - quite the opposite!
Thanks Doozergirl, I agree it's a huge relief to get over the subsidence problem. He was referring to the original planning permission for the conversion 25 years ago, which my solicitor told him right at the outset he didn't need due to the passage of time, and I instead passed him all the NHBC documents relating to the construction. He told my solicitor over 2 weeks ago that he was now satisfied with all answers and documents and was only waiting for the lender. But as soon as the lender gave permission, he immediately came up with this again! It's just as though he is absolutely unwilling to exchange. I swear to God he comes up with a new excuse out of thin air, every time it looks like we're sorted.
My solicitor now says she has left 3 messages and emails for him today and has still had no response. It's like :wall:
I realise we can exchange with the buyer absent but we still haven't agreed a completion date in order to do so, and that's why I want it wrapped up before he goes away. I thought exchange was jsut a matter of a 2 minute phone call so can't understand why he's still hiding....0 -

My solicitor finally spoke to the buyer's sol yesterday and uncovered some interesting info - don't want to go into details but let's just say that various parties have said different things to different people at different times - my solicitor described it as 'Chinese whispers - to put it diplomatically'!!
At least we seem to have cleared up what we are still waiting for which is a final green light in WRITING from the lender and then hopefully...
TBH, I have passed the hysterical ranting stage now and am just sitting back from it, while the EA does all the running...0 -
UPDATE: ULTIMATUM DAY!!!!! :eek:
Last contact with buyer's solicitor was Monday - he said he had faxed the lender for a written, rather than verbal confirmation that we could proceed, and then we'd be good to go. Since then, zilch. Not responding to messages from my solicitor or the EA. Meanwhile the other person who originally made a higher offer than my buyer, has been in touch with the EA again to say he still wants it and is ready to make another offer.
So - finally snapped. Got my solicitor to issue a 24 hour ultimatum to the other side to exchange or the whole thing is off, as I have another buyer. EA has said the same to the buyer. And I made clear I mean it; I'm not calling his bluff.
Am absolutely bricking it now and won't sleep a wink tonight but I know I've done the right thing either way. If that doesn't make them exchange, nothing would have. 14 weeks with no exchange for a no chain sale; it's an absolute joke!!
So will be a nervous wreck all day tomorrow until we get some news but will post the upshot.... never again....0 -

When we were buying 10 years ago we were getting nowhere fast with the buyers solicitors to the point we actually went round (to visit the sellers to find ou what the delay was) turns out they weren't as savy as us and didnt have fixed price conyancing as us and were being paid by the letter so the more letters they sent our solicitor the more dosh they got paid. As our solicitor was on fixed price she was as eager for it all to be done and dusted as we were.
Seems the sellers solicitors were trying to blame us ! When sellers made clear that the solicitors con had been rumbled it all went throu in lightning speed !Spelling courtesy of the whims of auto correct...

Thanks Fed Up. Good to hear it worked out for you - gives me a bit of hope for tomorrow. At the moment I'm pacing the floor, and have already cooked a big batch of curry and a batch of stew to keep myself occupied!!! So at least I've got grub even if I'm crying into it tomorrow!!0 -
The moment I never thought would arrive!! Finally exchanged half an hour ago. 15 weeks since offer on no chain sale to FTB! The longest 15 weeks of my life!
Following my ultimatum last week, the buyer's solicitor finally pulled his finger out and took the whole thing seriously at last. Even though they couldn't meet the deadline, he did update my solicitor daily and provided written proof of what he was doing to chase the lender.
Was also helped by the fact I spoke to his senior partner a couple of weeks ago and sent him a follow-up email asking him to keep tabs - naturally, he couldn't reply to me due to conflict of interests but I presume he did have a word as the solicitor suddenly became much more agreeable and proactive.
Am so excited!! Thankyou SOOOOO much to every single person who has posted replies over the past few months and given words of encouragement, as well as a reality check when I needed it! :beer:
