Purchased car 2nd hand with full mot but.........

    if they sold it as spares or repair, why would they put a new mot on it!?
    I would be looking for a full refund from these guys maybe CAB would be a good place to start for advice if they refuse - clearly dodgy business going on with the mot

    The seller should have been given the opportunity to rectify any faults, they will argue that they could have done it cheaper in their own garage. If you make them take the car back, they won't pay for the repairs you are having done.

    Basically they will make you work hard for every penny you get back off them. I suppose you could small claims them for the repair work needed to make it safe to drive, but I wouldn't hold your breath waiting for the cash.

    Absolutely agreed on that, but I'd still be speaking to VOSA.

    They won't be able to do anything official because repairs have been started but they still rely on information like this to target their (fairly limited) enforcement resources where they're needed. If the repairing garage is also an MOT station then ask if they'd be willing to confirm the faults to VOSA if needed. Good MOT garages would like to see the cowboys out of business just as much as everyone else would.

    Similarly, letting Trading Standards know what's happenes is painless
    and gives them a little more ammunition for when the next complaint goes in. People are forever saying that TS don't do anything in a particular case, but they generally need a good case file to show it's not a one-off. If people don't report things then they never get that file!

    From the ebay ad. you should have ran a mile, online only car traders are driveway dealers with opposable thumbs.
    Just to put your mind at rest the garage now looking after it now are just as bad! Cars with worn bushes don't jump into ditches and the cost of the linkages you quote point to drop links, the small interconnecting arms linking the body to the anti-roll bar. In most cars you could remove the drop-links, throw away the anti-roll bars, front and rear, and the average driver wouldn't know any different from the way it drives. Most drivers only notice anything wrong when they break and you hear the jingling of them rattling off something else. The brake story is debateable and the indicator could have been temporarily cured by giving it a thump for the MOT (tester are only allowed to tap lights).
    Basically garage two are short of work and I'm sickened by their ilk frightening motorists into emergency work that they pretend is desperate and if they had to send off for bulbs for a PT, they really are at the bottom of the heap. Get a few recommendations for someone else local to look after your new pride and joy and enjoy its brave styling.

    VOSA are not a consumer rights protection group.
    If someone takes a car to VOSA claiming the MOT to be incorrect.
    VOSA will inspect the car free of charge.
    If they find it is un-roadworthy, they will issue a VOR prohibition notice on the vehicle and it must be trailered away until repaired and the vehicle has the work repaired and inspected at a MOT station.
    They will not enter any discussion as to what they do with the MOT station.

    So why bother unless you want the car VOR and the expense of having it trailered away, on a 13 year old car, it is almost a dead cert you will have a list as long as your arm to mend.
    Will it get the OP their money back ?

    Fully agree with spaceys comments. It's an old knacker (despite being ultra low miles and not a scratch!) so for £300 odd to repair it, it's a lot less bad than it could have been.

    IMO yes you are, a 13 year old Chrysler is serious bangernomics, no it will not be a good car, it will be an absolute and utter sack of sht, sorry but it will be.
    Its a £500 car at absolute tops and you will get £500 worth of car, if you paid more, you were had.

    No.

    Wrong on just about every count.

    If they inspect and find MOT faults then they'll simply say it shouldn't have passed and may take action against the garage concerned. This will NOT affect the fact that it has an MOT, even if it shouldn't have.

    There are only limited grounds for which they can issue a prohibition notice and, if they find faults serious enough to do so, then you really don't want to be driving it until those faults are fixed anyway. But, once they're fixed, you do NOT need to have another MOT done.

    As for "VOSA aren't a consumer rights organisation" - who ever said they were? Their remit is purely road safety but they're always happy to receive intel about possible problems so they can make sure the testing scheme is working as it should.

    Reporting to them won't get you your money back (although it can help in a small claims case if VOSA have given a bad report on the car) but it is doing your tiny little bit to help stop the next person getting stung by the same cowboys. Who knows, if the last guy had done it then you might not be in the situation in the first place!

    You keep bringing up the same false reasons for not letting VOSA know about possibly dodgy testers to the point I'm beginning to wonder if you're a dodgy tester yourself?

    I sort of partly agree with you, and then you look at the advert.

    There is no reason why a 20 year old car shouldn't be in perfect working order, and I've recently bought a 13 year old mini cooper with low miles on the clock for my wife, which does not appear too bad.

    Nobody said it needs a new MOT, the prohibition notice needs to be taken with the car to a VOSA MOT station and be signed, the fee paid and it get lifted.
    The grounds for a prohibition notice are anything they find dangerous.
    They issued 27 at the roadside in one day in Bradford (yes we know why)
    So why take the risk.

    They were bad cars to start with.
    They can not be compared to things built by BMW, they were built in China by someone who gets a cup of rice a day with a gun in their back.

    If the garage you have the car at now had your best interests at heart they wouldn't have touched it, and they should know that too.

    But then again. they are getting a few hundred pound job aren't they...

    Probably not what you want to hear.
