As a long time lurker on MSE (who has decided to re-register due to stupidly having my old account as my real name) I just wanted to say
Good god Malchish, what planet are you on?!
Malchish is one of the regular trolls on here who insists on giving poor advice to anyone who will listen and has their own version of SoGA, DSRs etc. that they like to use and quote yet can never back it up with any links.
When any poster points out the errors he/she (they have never said which, which of course they are completely entitled to) then resorts to checking how many posts they make each day to try and discredit them by either stating they must be paid to post on such forums and lead consumers astray (consumer law is a big conspiracy if you believe Malchish's posts), or tries to make out they are lazy layabouts with no job and nothing better to do with their time.
I now look forward to the bashing I'll get for posting this
And to save you searching Malchish I've mounted up a little over 1000 posts in two years, ten months and twenty nine days and an average of 1.46 posts per day. This may change slightly as I'm also browsing other areas of the forum and may post again shortly.0 -

The amount of aggressive comments and childish name-calling by those 2000+ posters is funny. How angry they are! How upset they are after Firniture Village customers got £10000000 from the deceptive store back! Due to my stupid advice lol!
They got so angry when I posted guidelines by trading standards... all the same people... they got angry when I got a refund for a woman who bought a bulky rubbish... nd they got angry when I posted the DSR rules that the consumer can expect collection of their item.
Of course!
I hope that OPs will understand for themselves what is going on.
it is enough to search posts to see who is pro-consumer, and who is anti-consumer.
By the way, it is up to the OP what remedy to choose, not up to the retailer. They should do what the OP wants.0 -

Hi Malchish,
Please refer to the following sites:
Trading Standards
As well as:
Legislation.gov
The relevent point is that the seller can not demand a remedy that is disproportionate in cost. As a refund will be more expensive than a replacement or a repair, the seller is in their rights to offer them instead.
I have had a search for a news story of Furniture Village being fined £10m, however there is nothing. I presume this is made up? I also presume that you will post later an incoherent ramble saying that you have no need to respond and that you are right and everybody is just being mean.0 -
it is enough to search posts to see who is pro-consumer, and who is anti-consumer.
And it is just as easy to search posts to see who understands the SOGA and who doesn't, and you are clearly in the second category.
As has been pointed out to you many times (with links to the relevant legislation), a consumer cannot demand a particular SOGA remedy, They can state their preference, but the retailer can refuse this if a different option is more suitable for them. (ie, if what the consumer requests is too expensive compared to what the retailer wishes to provide).
There is nothing wrong with being pro-consumer provided that you don't get blinkered in your view of what the consumer is legally entitled to.0 -
The fact is that most people on this site are neither pro-consumer or anti-consumer.. to suggest otherwise is like saying you have to support far-left or far-right politics. The reality is that the majority of people are situated somewhere in the middle and offer support advising of the correct law with understanding of both sides.
If shops were to act under the 'Law of Malchish' prices would rocket and businesses would fold.0 -

I've only been on the site a few weeks but it seems most people are pro consumer.
The slogan of the site is "cutting your costs, fighting your corner".
So to say the majority of people are sat in the middle seems a bit ridiculous! Its very much a pro consumer site!
For one thing if a company posts on here without permission they are instantly berated and then reported to the admin people because they don't have permission to post! Its not a friendly place for business's!0 -

I am talking specifically about this board (rather than MSE as a whole).. if you compare this forum to one such as CAG you will find this site is more balanced with views from both sides pushed equally. I do agree that businesses are quickly jumped on, but that is more about rule breaking.
And by "sat in the middle" I am comparing to Malchish who goes to the extent of making up their own version of laws in order to give "advice" to posters.0 -
Well, I don't know what to make of things now.
John Lewis were supposed to send my ipad to apple today, instead the guy that booked it in rang while I was at work, seems he decided for reasons unknown to try and fix it, he set the whole thing back to factory settings and happily told my daughter that he'd fixed it! Doesn't he think I haven't already tried that! It puts it right for a few days, when my daughter pointed that out to him he just replied that there was no point in sending it to apple now because he'd fixed it!
The thing I'm most annoyed about is, when I dropped it off it was to be sent to apple, that was the agreement, I'm surprised that this guy has taken it upon himself to actually mess on with it!
So now I'll collect an ipad that will be back to square one in about a week!

Collect it, book it in with apple and do it on the day when you can prove the fault. Remote repair is a real minefield with issues that aren't consistent like yours.0
