Civil Recovery Fine from Sainsbury's solicitors - Advice needed urgently

    I don't understand how anyone can suggest the op pays this money. If Sainsburys didn't take it any further then no crime was committed. I'd have a word with Sainsburys head office nd see what they say.

    I'm wondering if this has happened to anyone else and if anyone can advise.

    My friend's son was recently accused of shoplifting in a Sainsbury's supermarket after forgetting to pay for some items in his basket. My friend's son can be quite absent-minded and has assured her that it was an oversight on his behalf. He is also a Sainsbury's employee so wouldn't be stupid enough to try to steal from one of his own stores.

    He was questioned in-store but let go.

    A few days later, he received a letter from DWF LLP saying they were solicitors acting on behalf of Sainsbury's saying that he had to pay a fine of £150.00.

    The sum was broken down as follows:

    Value of goods stolen £0.00
    Value of gods damaged £0.00
    Value of cash stolen £0.00
    Security costs £150.00

    Amount now due £150.00

    There s a Q&A sheet attached to the letter saying that this is a 'civil recovery'.

    My friend's son was told nothing of this when he was questioned in-store and he explained his error to them. There was clearly nothing taken as shown in the 'costs' but now they are saying that he owes for 'security costs'. How can that be when the security would have been working in-store at the time already anyway?

    There is also no information in the letter on how he can appeal this decision and fine.

    Has anyone ever come across something like this before? Can anyone offer any advice? Is Sainsbury's allowed to do this?

    Any help would be much appreciated.

    need your advice.By mistake 1 item was not paid by me & I was waiting inside Salisbury for cab when manager came to me & asked to check my shopping. Finding that unpaid item, they took me to a back room my bags+purse were frisked my bag & he took my emp-id card number & NHS card number.He took money from my wallet & sent his staff to pay for that item.He called me a brown thief and was very rude to me as I am from India. He did not call police & let me go with a latter banning me from Salisbury. After a week I got a letter from DWF asking for £150 for security charges. I read lots of forums where people have been placed in same situations. Mine is little different as I am not British citizen, I m on work visa here. My query:
    1. My visa extension will be in Jan 2015, will this affect that? Can I be denied extension?
    2. Will DWF inform NHS or my Employer about this if I don't pay them (as everyone suggests)
    3. Can DWF take me to court for not paying as I am not British Citizen?
    4. Can there really be a court case on me as then my career will be finished.

    I have had he same problem a friend was caught switching a tag on an item of clothing in asda stores he was taken the back room where the security guard told him if he told the truth about what he had done he would not call the police of Persue the case further. Obviously a week later he has received a letter similar to this from DWF stating

    Value of goods stolen 0
    Value of goods damaged 0
    Value of cash stolen 0
    Securuty costs 125
    Total 125

    They stated that heI had 7 days to pay and he had not replied since, they have since got back to me after 8 days with another letter stating the same charges saying "we write in our reference to our letter dated ******** and not we have not received your reply" they further go on to saying "we assume this was an oversight on your part and require payment of the above balance during the course of the next seven days" then it has a list of payment options and at the bottem it said " we await your payment or response during the course of the next 7 days"

    Please could someone help me out with this as my friend is in two mind as to what to do,

    In the second letter they never stated if he didn't pay there would be any further action.

    If any pictures are required I would be happy to send them over for any help,

    Any help or advice would be much appreciated

    Just follow the advice above, just ignore them regardless of threats of court etc you may receive.

    I often wonder why people post their problem on an existing thread, and don't bother to read the actual thread. (As if THEIR situation is entirely new ... if it is, why did you post on someone else's thread?).

    I often wonder why people who have been on this forum for a long while, get so much pleasure from having a go at a first time poster.

    I often wonder why some people start calling others a troll, when they are the guilty ones.
