    If Sainsbury's thought it was theft, they would prosecute end of. But as it appears not to be, this other company has come in to try and get a quick buck out of, no doubt giving Sainsbury's a back-hander.

    Have you ever made a complaint to the police about theft?

    I have and its a nightmare.

    Statement taking takes 2 hours of an employees time which often is more than the cost of the item stolen and as such its not worth Sainsburys time in prosecuting. Never mind other associated costs!

    Personally anyone convicted should have to pay back costs of investigation (to a limit).
    Don't trust a forum for advice. Get proper paid advice. Any advice given should always be checked
  • Retailers got spanked.

    RLP do 11,000 'invoices' a year. 60-65% of these civil claims are ignored.

    20-30 a year get a cc claim issued. Very few of these proceed to court.

    Basically dedicated shoplifters simply ignore these civil recovery letters.

    Occam's razor - This was a simple mistake and this parasitical company has swooped in to make money from it. Perhaps they'll sort out Sainsbury's PPI claim while they are at it.

    Reading between the lines, it sounds to me (and a few other posters) that the OP's friend's son was shopping at a different branch than he works at so maybe they didn't realise he was an employee.

    My friend's son can be quite absent-minded and has assured her that it was an oversight on his behalf.

    Having worked in retail all my life, it is amazing the amount of times people walk into a shop with no goods, walk out with goods without paying & apparently it was just a mistake!

    Funny how I & so many people I know seem to have yet made that mistake!!

    In post # 14 (page 1) I explained how I almost made a simple mistake.

    I do believe that mistakes can be made.

    The point I was making to Halibut's post was we don't know either way if was a simple mistake or a deliberate attempt to get away without paying.

    From the content in Halibut's post it seems clear to me that he/she is of the opinion that anyone versus Sainsbury's would be in the right, regardless of the situation.

    I just don't think we know enough to say whether this 'parasitical company' or the OP's friend's son is in the right.

    Not at all. I'm saying that if Sainsbury's believe a theft took place, then get the police involved. If not, then don't.
