    For £27.50 the County Court Small Claims process is simply not worthwhile.

    It will cost far more in time, money and effort than it is worth.

    The Defendant, the fraudulent buyer, can ask for the case to be moved to his local court so the Claimant, our OP, would have travel expenses.

    I also doubt that, even if the OP wins, that he would be awarded any expenses.

    To win the court case, wouldn't the seller have to offer proof that they had sent the working camera? Won't the buyer simply claim it was the seller who swapped it for the dud? [The buyer obviously has had practice at this kind of thing].

    The seller does not need court.

    They need to ring eBay and appeal the case or do it via the resolution centre. Go to resolution and type "buyer returned a different item".

    With the correct evidence they WILL get their money back by a reimbursement from EBay.

    They will also have any lows and feedback removed, along with dashboard strikes.

    I'm not saying the seller NEEDS to do court, I'm simply saying they could if they wanted to - it would put a lot of stress on the buyer :)

    I appreciate that, but I am saying there is a safeguard in place with Ebay, I do hope the OP has read this and will take action. The appeal will go in the sellers favour if they present the evidence.

    Time for a very late update. It took months but eBay did refund me and ended up banning the individual from the site. Unfortunately that was it but you live and learn. I haven't sold on eBay since!!!
