In theory you're right, but in real world terms it's very, very unlikely that him answering his phone is going to cause or prevent anything.
But, in the real world, it's illegal.0 -
No ifs, buts or maybes, instructor is breaking the law and if he doesn't understand the basic learning mechanism of, "monkey see, monkey do" he really isn't in the right job. Incidentally if stopped and both instructor and learner failed the attitude test, the learner could be charged as well (being unsupervised during the time of the call) due to driving otherwise than in accordance with a licence.0

In theory you're right, but in real world terms it's very, very unlikely that him answering his phone is going to cause or prevent anything.
In the real world the instructor can't concentrate fully, just the same as if they were driving the car. The instructor is in charge of the vehicle, and must be fully concentrating at all times, so that they can take avoiding action in an emergency. This could include using the dual controls, and/or grabbing the steering wheel.0 -
Well, if a driving instructor's spouse was a rotten driver, the instructor shouldn't allow them to use the car that has their business details plastered all over it.
It's bad for business and it's a poor advert for their teaching skills that they can't help their spouse to be a better driver.

From your username and avatar, you are giving the impression that you are an accident investigator. Yet you seem to have a very blas! view about the driving instructor illegally using their mobile, when they should have been fully concentrating on their first time student.
I have a view that its not the crime of the century. Yes, I deal with many accidents, the causal factors are ample and varied. I can't ever recall an incident involving a driving school car whereby an instructor was on the phone, so from my small window of experience and in the grand scheme of things, it's just not on my list!
Sure, the instructor shouldn't do it but he's in a minority. The greater motoring public on phones is the real issue due to the numbers.0 -
I'm not sure what the legal implications are, if any, but I would complain if you feel uncomfortable about this.
Very simple. He can not use a phone unless it is hand's free, as he's in charge of the car.
I'd be livid.
My DD's instructor occasionally asks her to pull over, and will check his phone which is on vibrate, and will occassionally make a call. Once the car is stopped. He tells all his pupils to text rather than call, and he will respond at the end of the leason he is giving.0
