    Why? To stop the person from blocking the chaps garage!

    Of course it depends if he has a drive leading up to the garage. In which case there would be no obstruction or criminal damage.

    Obviously a little bit of common sense needs to be applied. I dont think anyone would go bolting this into the pavement if it dosent have a drive.

    How many tenants do you know that hold the freehold to a council garage they rent?

    I didn't make the decision the high court of the justiciary did many years ago. Only government agencys and court appointed officials can clamp in Scotland. Scotland has it's own laws and legal system.

    I didn't make the decision the high court of the justiciary did many years ago. Only government agencys and court appointed officials can clamp in Scotland. Scotland has it's own laws and legal system.

    Well I've just looked, in Scotland you have to permanently deprive and the theft must be for profit.

    So if you do it to teach them a lesson and don't demand money it isn't theft.;)

    It would be no different to renting a flat and putting a picture up on the wall.

    When the OP has to hand the garage back to the council, as long as he makes good any improvements/damage etc then there would be no comeback.

    They have rented the garage not the road surface or ground leading up to it.

    No it wouldnt.

    We don't know that. The garage might have the apron included. If it does, then my advice still stands.
