They didn't ! Basically 1 email said no safe place for babies and 2nd said would you consider another litter ?

It may be a simple thing but have you actually told the CPL that you are prepared to 'pay' for the kittens? I assume you didn't 'pay' anything for mama as they wanted rid of her (sorry I don't mean that to sound harsh but that is how CPL would view it, they certainly would not be want to be stuck with a feral cat). It is standard practice at all sanctuarys that people give a 'donation' when they re-home a cat to help with the cost of all the treatments/housing they have received.0

Their website states £50 for a kitten or £ 80 for 2 x TBH would pay anything they wanted

I appreciate that but have you actually told them that? Looking at it from their point of view, they might be thinking you are expecting to get them for free (like mama)? Money might be the reason they are favoring the other person over you.
PS our local CPL charge more than that (must be a regional thing again)0 -
Yes I did tell them that x I realise it costs more than double that for their care and would of expected to pay more ! ( they do say costs vary from branch to branch ) I'd pay what ever they wanted ( my boys have already given me their savings books and said take what you need ! Bless them ! )but it seems we will fail on the home visit so money not even part of the equasion .
Mama is a stray , however we do have her registered with the vet as stray or not she came back to us and deserves to be looked after the best she will let us ! When you say they " gave Mama back to us " she wasn't ours , like I said she was stray , what I don't understand is , if they are for protecting cats , how is my garden safe for Mama ( or babes from another litter ) but not the babies ?
I feel I'm typing in a nonsense way at the mo , sorry pet , I just canne think straight till I get it sorted

How about sending an email something along the lines of
I have been speaking to my husband and as we have made clear from the start we really want to give these kittens a home (add something about keeping the whole family together, hence why you agreed to take on mana otherwise you might not have been so willing to have her).
We are prepared to pay to make our outside area meet your criteria, I have been looking into the options of making it enclosed so it is safe and will go ahead with this if you think it is necessary after your home visit. I am also quite happy to give a donation for the kittens as per the guidelines on your website. I understand that you have had costs involved with vets treatments and would appreciate if you could look at your records and advise what you feel would be a fair donation for us to give for these two.
Send an email now so they have time to digest it as I am sure by the time the home visit is a decision will already have been made and they will only be going through the motions.
EDIT: sorry cross posted with you and it seems like doing something like the above may be pointless

Oh it is horrible to hear you so upset...come on, channel that energy and FIGHT!!! make some phone calls right now, find out who is in charge at this CP centre, make noise, do whatever it takes!
FWIW, I would not leap into building on the patio right now. get the plans in place...cat enclosures suit some people, in my case it was easy enough to enclose the whole (smallish) garden.
Some CP centres might have a 'no indoor cats' policy....and might not count the enclosure as garden access which is why I say to find out what THEIR criteria are and then promise to meet them.
The kittens will all surely be indoors till they are neutered so it is not as if this enclsure has to happen tomorrow.
IF CP are seen to allow this kind of 'cherry picking' of the cutest kittens then it would look VERY bad for them. You want the kittens as you want the whole family, and your championing of wee Magic proves that....black cats are always the last to be homed whereas greys or colour points have no trouble.0 -
ooh, just thought, maybe you could give us a hint as to which FB page we could look at to err, support this local CP branch.
maybe the knowledge that hundreds of other members of the public are aware of this potential situation would bring some pressure to bear.0 -
