Please accept my apologies that I failed to mention the DSR exact specifics.
Our advisors are fully aware of this statutory right however as DSR's didn't matter in this case as we already knew the time period is greater than the 7 working days associated with DSR and is irrelevant in these circumstances - I briefly just mentioned the Distance Selling Regulation as this had already been posted by others.

I was told by the customer services rep who took my order for this fan that I COULD return it within the 28 days if I wasn't satisfied with its performance. This morning I spoke to littlewoods about the return of this item and stated what I had been told. I was subsequently told that this conversation would be listened to and if the person who took my order had indeed informed me incorrectly then I could return the item. I asked if I too could listen to/have a copy of this telephone conversation but was told I couldn't. Today someone mentioned that I could. So that has to be sorted out. I was informed by littlewoods this morning that someone from would be ringing me today about this recording. As yet, in spite of being home all day, no one from Littlewoods has phoned. Which doesn't surprise me.
I wasn't given a 7 day cooling off period where I could return the goods. I'd never heard of it until now.
The fan is not fit for purpose and so I'm cancelling this order in accordance with the distance selling regulations 2000. (At least that is what I'm trying to do).
I deliberately asked the sales adviser if I could return the item if it was unsuitable due to the reviews that stated it was too noisy. I wanted to be sure I was able to do that in case I too had the same problem and I was told I could. I hope this spoken evidence can be listened to sooner rather than later.
Finally there was absolutely no need for a warning of what could happen if I damaged the item. If you'd bothered to actually read my reply on here I stated that no way would I resort to this. Others may have indicated they would. I stated I had no intention of pulling wires out or anything else for that matter. End of story. So it was quite unnecessary of you to bring that to my attention!!
Whether I'll be able to successfully return this item I don't as yet know. But if what I was told this morning about that tape recording being good evidence then I hope the matter can be settled once and for all.

Under no circumstance was I suggesting that you'd damage the fan to have it returned. I simply mentioned this as others had also commented with similar suggestions. Please accept my apologies if you thought I would suggest this.
If you feel you have been misinformed by an advisor in regards to the fan being able to be returned you can email your details to us at Help@Littlewoods.co.uk. We can then listed to the call in question and see what was advised.
However we must advise that whether or not the advisor told you conflicting information, all of the details regarding the fan being non returnable are printed both on the website and in the catalogue and it is up to the customer to check these details first.

This may be the case however; I'm not aware of any conversations you've had or how many different people you have spoken to regarding this matter. I can only answer what is posted on here.

Littlewoods are admitting here that their official representatives, both on the phone and here, can say what they like to consumers to get business and then will try and get out of their false claims. This post will pretty much guarantee you a win in court to get your money back. If Littlewoods have any shred of decency, they will offer you a full refund now "as a gesture of goodwill"

The fan is not fit for purpose
Why? It is fit for purpose! The amount of times people don't understand what fit for purpose actually means is unbelievable!
Basically you don't like it because it makes a noise. The vast majority of fans make a noise unless they specify they are completely silent which I've not noticed one that has.
The fan blows air, therefore it is fit for purpose!
Stop confusing you don't like it because you can't sleep through it and what fit for purpose means. It might not be fit for your purpose but that is not what fit for purpose means in the eyes of the law.0 -

I don't find it far fetched, the rep clearly says that whether or not OP was given conflicting information on the phone is irrelevant because the correct information is on the website and in the catalogue.
That would give the telesales staff a clear go ahead to lie about anything they can to close a sale over the phone with no comeback. If the sales person stated something in regards to the sale it then becomes part of the contract and can't be retracted at a later date.0 -

This could be an isolated mistake, we still don't know. So gathering from just pure speculation that Littlewoods have some policy to lie to get a sale is a bit far fetched!!0
