if it goes 50:50 your insurance doesn't pay anything either, the other insurer pays their own damage.

The "correct" approach is to inform your insurer, (this is in the T&Cs of your policy) tell them that you don't wish to claim for your damage if you like, and accept no responsibility/blame, let them decide.

50/50 means each party is entitled to recover 50% of their clients damage from the other party.

Assuming they're both comprehensive (and claim from their policy) the OP's Insurer would pay for the OP's damage with the OP paying the relevant excess. The OP and their Insurer would then be entitled to recover 50% of this from the other party and the other party and their Insurer could do the same

I think Facade is confusing 50:50 with knock for knock. The latter is defunct.

Defunct by 15+ years and one of the main reasons why young drivers premiums are now so much more expensive than when "knock for knock" existed.

My bad, still living in The Olden Days, when everything was better :o

So if the OP claims say £255, and their excess is £250, would they get half the excess from the other insurer (£125 so the OP pays 130 to get £255 worth of work done), or would the OPs insurer claim half the OPs excess even though they only gave the OP £5 (the OP pays £250 for £255 worth of work, and the OPs insurer makes £120)?
I want to go back to The Olden Days, when every single thing that I can think of was better.....

(except air quality and Medical Science ;))

It's not the greatest example due to if you have an excess of £250 you can only make a claim on your own policy for sums in excess of £250.

If say the OP had an excess of £250 and their own damage was £1000 they could claim for the amount over their excess eg £750 from their policy. They could then seek 50% of their excess eg £125 from the other party.

If the OP's damage was £250 or less, they could allow their own Insurers to pay 50% of the other parties damage (Including the same percentage of their excess). The OP could then pay for their own repairs and seek to recover 50% of this from the other party.

In your example they would pay their £250 excess and get £5 of work carried out by their Insurer and they could recover 50% of their excess and their Insurer could recover 50% of the £5 from the other Insurer.

Either way the OP would have a fault claim registered against them and their no claims bonus would be affected unless they have protected no claims bonus as would the other party.

Then what happens in 6 months time when an ambulance chaser cold calls them about claiming for injuries? It would be hard to defend an injury claim if you have already paid for their vehicle damage.

Sorry been offline...What if I was to get a signed receipt of money saying it was without liability or without prejudice?

In that case why would you be paying out?

To just move on, and not waste any of my time with insurance companies?
I think I just see it as I can pay £250.00 excess and increased premiums for 3 years plus OR just give the woman say £200 for her repairs and forget about it

    EDIT> When I say I, I mean the wife.....

    Speak to the other party.

They probably don't want to go through insurance, anymore than you do.

People settling outside of the insurance companies happens day in day out.

Others on here are giving worse case scenario , which in real life is not the case for a silly supermarket bump.

Don't you just pay for the damage to your own car? I wouldn't be paying half for the other party.
