    Makes no odds really.

    The Op just wants a quiet life and yes it would probably go 50/50 at the insurance.

    But Will cost the OP a lot more than £250.

    If the Op starts messing around, the other driver may contact his insurance.

    For the sake of £250 its not worth rocking the boat.
  • Tell the other party that you think they were to blame and if they want to get the insurance involved, it's fine by you.

    It sounds 50/50 to me too. If it were me I'd speak to the other party and tell them you'll pay their £250 as long as they pay the same for repairs to your own car. Don't see why either of you should pay the other if it's 50/50.

    The £250 excess applies to your claim not the third party one. If you inform your insurer and say that you don't wish to claim for repairs to your car, it won't cost you a penny, if it goes 50:50 your insurance doesn't pay anything either, the other insurer pays their own damage.

    You will have an increased premium due to an "accident" however, but so will the other driver.

    The "correct" approach is to inform your insurer, (this is in the T&Cs of your policy) tell them that you don't wish to claim for your damage if you like, and accept no responsibility/blame, let them decide.
    I want to go back to The Olden Days, when every single thing that I can think of was better.....

    (except air quality and Medical Science ;))

    Almost certainly 50/50. I'd tell them both fix our own damage and part ways. If they want insurance involved, then fair enough

    My father reversed out of his drive same time as as the old couple opposite was reversing out the insurance called it 50/50 but then a few weeks later they tried to claim against him for the cost of a rental car car plus compensation for the stress its caused them saying the old woman was in tears for weeks after

    If the other party claims on your insurance I dont think you pay an excess, that's only if you make a claim to repair your car from your insurance company.

    I would also vote 50:50 without question, but you have two options
    - just pay it and move on (and hope they don't make a fraudulent whiplash claim in the future)
    - tell your insurer, tell them you think you was both at fault and see how they want to proceed

    Would have been easier to agree joint fault at the scene and each repair each others car and drove away. Once details are swapped it makes not telling the insurer a very high risk move - probably not worth the risk now if you ask me

    Then what happens in 6 months time when an ambulance chaser cold calls them about claiming for injuries? It would be hard to defend an injury claim if you have already paid for their vehicle damage.
