Crashed and don't know who is at fault.

Hello. My OH was in a supermarket car park and reversed out of her parking space at the same time as the person opposite and BANG.:mad:

She doesnt think shes at fault but is not 100%. Her car is a few scuffs and the other car is scuffs and a gouge, nothing major and her excess is £250 with protected NCD.

Without admitting liability we told the Other person to get a quote, they came back and said definately under £250 and will get a written quote later.

Do we
  • a) Go through insurance probably getting a 50/50
  • b) Just forget the hassle and pay for the other car mending as its under excess and also no increased premiums next year
  • c) something else?

    £250 sounds too cheap, be careful.

    I'd go 50/50 without insurance involvement.

    What does the other party say?

    Other party is saying they are not to blame at all.

    The under £250 is for their car so I am not bothered if its too cheap. :-)
  • Insurance would go 50-50 on that.

    Both drivers were at fault.

    Exactly... so wouldnt we be better off just paying under £250 for her car to be sorted instead of the £250 excess??
    We arent too bothered about the scratches on ours so probably wouldnt do anything with it for a while.

    Which direction was the other party facing? if they were facing forward then chances are you OH maybe held liable, always reverse into a parking space so that you exit in the forward direction.
    On another forum, some said they had gone to a restaurant and whilst they were reversing out of a space a travelling car and theirs collided, he sadly got held liable as he was reversing and was deemed to not make sure it was clear and safe to proceed.

    If this becomes a claim, insurance company will want to know why it was not notified to them asap. In fact even if it does not become a claim they require you to tell them. As said earlier, be careful!

    Just pay them the £250. Get a receipt signed, saying full and final settlement.

    Much cheaper in the long run and get on with your life.

    Thanks GAZ237, exactly what I was thinking but was just wondering if there was any point in arguing it through Insurance
