    What offence were you arrested for?
    That doesn't sound right, generally victims don't get arrested unless they are also doing something wrong.

    Witnesses aren't cautioned, it wasn't needed in your case as you weren't driving @ the time.

    She has not been asked if she was cautioned/read her rights. That's what I said so all of those quotes are irrelevant.
    Witnesses aren't cautioned, it wasn't needed in your case as you weren't driving @ the time.

    I was given the full "anything you say may be used in evidence"

    You weren't there I was. Are you calling me a liar? I am simply suggesting the OP may have been given the same treatment and as such, not really having an idea about this might well have thought she was being arrested even though she wasn't which is exactly what I said.

    Rather than trying to bully her I am simply trying to understand the situation.
    What if there was no such thing as a rhetorical question?

    Going back to the original post:

    If you want the car fixed, you have 2 choices

    Pay out of your own pocket
    Claim on your insurance (if you have fully comprehensive)

    You will need a crime reference number (to prove it wasn't done by you) and I would think it counts as a vandalism claim.

    Some insurers will not alter your no claims bonus for a vandalism claim, Direct Line is one (but will load the policy at renewal)

    You can then explore ways of recovering the money if you paid youself, or your insurance can worry about it (my preferred option)
    I want to go back to The Olden Days, when every single thing that I can think of was better.....

    Also, as the OP isn't telling us everything, there is a possibility that she kicked off, and were both arrested to prevent a breach of the peace.

    The only way we will know is if she tells us exactly what happened.

    She would have been cautioned arrest and again in interview.

    What a said was there was no need to caution you as you weren't driving at the time.;)

    Doesn't mean it didn't happen though does it? And therefore easy to see why the OP might have been confused if the same happened in this case ;););)

    So in summary, you were wrong to say what you did about avoiding that particular question.

    Now that we've estabilished there is no need to be nasty but every reason to be sceptical - lets get the thread back on track eh?

    No, I wasn't wrong. The op stated they were arrested and therefore would have been cautioned. Also they would have been put in a car and taken to a custody block.

    You you tell me what they would have been confused about.

    Stop being pedantic.

    If she was arrested as she claims and has given an account she will have been cautioned twice.

    Just because you don't know how the system works did doesn't mean others don't. ;)
