Facing disciplinary action - HELP!

    No doubt you are aware that prisoners fall into the vulnerable adult group and that you may well be facing allegations of misconduct in a public office, and in some cases allegations of misconduct are referred to the police. How you are dealt with may well depend on who employs you, but as you may know, if the allegations are proven you will be barred from working in any prison regardless of who employs you for a considerable period of time and maybe indefinitely. If you new job involves working with vulnerable adults you may find yourself in a precarious position, and if the job is in another prison then the job offer will be withdrawn. My advice would be to seek legal advice pronto.

    I know love is blind sometimes, but is it worth it if it puts your livelihood at risk.

    Thanks for your comments, however I do not work for the prison service and do not hold a position in 'public office' because of this. I work for a charity based which is sub-contracted by the prison service. I doubt any criminal proceedings will come against me due to this, and based on previous similar stories I have heard from my colleagues where other members of staff have simply been dismissed for having relationships with CURRENT clients.

    Yes, I know that my relationship is inappropriate, yes I knew I would eventually be found out, hence why I resigned in the first place, to try and avoid any ramifications.

    Neither of my job offers are based in prison, nor do I wish to work in prison again, it was merely a stepping stone in my career, so my future prospects of working in within a prison setting are not of concern to me.

    Sweet talking man or woman. It is very easy to make an error of judgement when the heart is involved. There is another board that could easily be renamed the boulevard of broken dreams.

    Oh and apologies for the musical reference.

    Maybe the OP employers haven't yet realised that she has resigned and that going through the disciplinary process is pointless box ticking.

    They are fully aware which makes it all the more confusing as to why they are bothering with a disciplinary when they could easily just dismiss me for gross misconduct, unless they have very little evidence and are hoping they will glean more from me at the hearing...

    You may find that you may be considered as working in public office. Whether you are referred to the police will be the Governor's decision not your employer's. I have managed staff facing similar situations, none of whom worked for HMPS. One which was referred to the police though no action was taken. You do really need to get expert legal advice, do not rely on ACAS. Also do not rely on advice from colleagues. Times are changing in the prison service and where staff may have just been dismissed in the past, this is no longer the case in all cases.
