    As jac said, they can state you resigned whilst suspended and under investigation for xyz.

    Get legal advice to see if they can make it go away as it sounds fairly subjective anyway.

    You may find that the new companies don't have similar clauses so aren't actually bothered about it if you explain it. But you risk messing it up without appropriate legal advice.

    They can also refuse to accept your resignation while your under investigation.

    I'm not sure this is right...according to gov.uk:-
    "An employer can’t refuse to accept someone’s resignation and they must follow certain procedures.
    When a member of staff resigns you must:

    get them to confirm their resignation in writing
    tell them what their notice period is
    agree when their last day at work will be
    confirm whether they should work all or part of their notice period"


    All of which I have already done as I am currently working an extended notice - I am only required by my contract of employment to work 4 weeks' notice, which I have done. The only reason I went back into work this morning after a week of annual leave is because I requested to extend it. If I now tell them I am terminating my employment with immediate effect, surely there's nothing they can do about it?

    Ok. I would explain to your employer that you have been in contact with said person but you did not think that it was reportable, and you do no wish your private business to be company knowledge.

    Also contact new companies and just ask how things are coming along, and see if references had been received.

    I could plead ignorance but unfortunately it is written in my staff handbook that we are not allowed to develop relationships outside of work with clients for up to two years after they stop using our services. So unfortunately I can't really say much on that front because I knew what I was doing was wrong.

    Good idea on the reference front, I've already contacted the second company and they said they will be requesting them in due course, so I know it will come to light with them, but the first company I have no idea about so might just have to contact them and find out.

    As others have said this is wrong. A reference can have anything in as long as it is true and pertinent.
