They had no right to pay a private (fake) PCN unless the car use t&cs allow it. There is a big difference between real PCNs and private ones, and a contract that only states 'fines and penalties' DOES NOT refer to fake private ones which are mere invoices. You seem to minsunderstand us on that point.
Your firm should be passing on driver's details so they will then have zero liability. Why are they not doing so, nearly a year after the Protection of Freedoms Act 2012 (England & Wales only) gave lease car firms that get-out, as far a fake PCN s are concerned?
Was this in England/Wales?
If in Scotland then the 'invoice' was only EVER the business of the driver, in law. Not the car owner/keeper.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

No help sadly. This forum is lacking in facts hencey 4 out of ten rating. Might have to change that to a three. Am used to car forums with fast ansers based on fact and experience not guesses.0 -

So i have a company car which i overstayed in a car park which takes photos on enetry and exit. So we know it was an overstay. 45 quid charge which has been paid by my employer. They emailed and wrote to me to ask if they can deduct it from my wages. I werent up for that cos if it were my car i doubt id be paying anyway. Can work ask me for it? Ive taken zero ation yet. And theyve asked me again if tbey can take it this month.
Your employer can only legally make statutory deductions (such as NI, tax etc) from your salary UNLESS you have a written agreement allowing other deductions or it is written specifically within your contract of employment.
A parking charge notice issued by a private company can at best, be a civil debt meaning that your employer should of simply passed it on to you. A private company cannot issue a fine or penalty as they have no legal status to enforce or recover penalties or fines in English law. A parking charge notice can only be 'enforced' via a civil court via trespass or breach of contract legislation.PLEASE NOTEMy advice should be used as guidance only. You should always obtain face to face professional advice before taking any action.0 -

Call a troll a troll. Insinuate and nobody knows where they stand. My reasons for being here are clear: to save money. Not trolling. But evidence ive found leads me to be at odds with other members. Thats certainly not trolling. Not being able to link is counterproductive too....0
