    So if it goes to small claim court I won't be able to do it through a UK court? Thanks.

    Correct - the local Court is also in Swords but don't let this put you off if your case is 'sound'. My Court case cost 15€ (£700 or so claim amount from memory) and RA paid out before claim was heard - this was not a delay claim by the way.

    No, just notified them that I intended to claim for the flight that was delayed and expected a response from them.

  • American Airlines does not respond to correspondence in my experience. I filed in the small claims court a couple of weeks ago and AA has not reacted in any way. Presumably (this is uninformed guesswork) they will not defend the claim as they are content to have judgments against them, since (1) judgments will not be enforceable due to their Chapter 11 status which gives them immunity against creditors, and also (2) they have no assets in this country so no way enforcement could be succesful.
    Any informed opinions gratefully received.

    You assume correctly. Staff sickness and absence due to a variety of reasons is not a reason to deny your claim and adequate provision to cover such should be part of normal business planning as it is in most other businesses.

    Thats what I thought. Do you know of anywhere which will state this that I can reference to them?

    There isn't a list that itemises every single instance of what is *not* an extraordinary circumstance... the list would be too long as it would cover just about every single thing in all walks of life.
    Instead there is a list of guidance on the CAA website of things that *might* be considered to be extraordinary, so that's your starting point.

    Unfortunately Gleno, the 'submit a claim' terminology refers to actually filing the claim in court, not continuing correspondance with the airline.
    So you are out of time.

    If so, then yes it's a BA error as the distance is less than the threshold for reducing the compo by 50%.

    If it had gone to court as seems likely with the delay claims I assume you can have it transferred to a local court or is that not how it works?
