I thought that if the car was on finance then the finance company owns the car? I had a car on finance (conditional sale) and i was told that i put the owner down as Santander? I don't think there is much difference between HP and conditional sale.

No, you are quite right in those circumstances.
However, there are other 'finance packages' too..which are in effect simply a 'loan'.
I had no more precise information at the time.
Which, in the greater scheme of things, really didn't matter.
The important point being, the car is not the OP's asset.
Where schemes like HP are really important in a BR, concerns whether the BR person can retain the use of a high-value vehicle..or not.No, I don't think all other drivers are idiots......but some are determined to change my mind.......0 -
Hi everyone again, getting close to Monday now and im neavous about these forms, I have done most of the forms, I did ring citizans advice, but they couldnt see me for around 3 weeks, and I have to go to the court Monday as thats the only day my mum could get off work because she is busy.
The question im stuck with at the moment is 6.3 What is your average monthly take-home pay (include, for example, overtime,commission and bonuses). Do I put my job seekers allowence here? And do I have to fill in questions 6.4 and 6.5 how much tax and national insurance I pay, because I dont know this, I know what it was in my last job.
I have put my job seekers allowence in question 6.6
Also stuck on question 6.7 How much do other members of your household contribute each month to the household expenses? Do I have to put here what my parents pay? as they pay the mortage and water and everything I pay them £140 use to be £250 a month but what they spent that on I dont know.

I would imagine your average take home pay is zero as you are unemployed. JSA would come under benefits i believe.
Not sure about your second question though.0 -

leave section 6.2 blank or N/A
section 6.3 put N/A
6.4 AND 6.5 put NONE
TICK 6.6 box and put your monthly JSA figure below
i left 6.7, 6.8 and 6.9 blank, i could not be bothered to work it out, no-one has complained so far.
i guess if you know you could fill it in, as your on JSA they wont be an IPA, which is what the OR wants to find out.0 -

is your JSA income based or contribution based? im guessing with the amount you are quoting its the later, so im not sure if you can claim back the £175 court fee, im on income based JSA and the court fee was waived with a letter as evidence.

Thank you for all the help, I am on contribution based job seekers, I was told by CAB that I would pay £525, that is all the money I have, my parents have helpped me get that.
If I go to the court tomorrow and they say it is £700 what is the best thing to do? I have money on my overdraft but thats it, and I was advised by CAB not to use that, unless I really had no choice.
Also if something on the forms is wrong, what happens? do you get the money back and told to redo the forms?Went Bankrupt on 24th July 20130 -
Hi, you can claim the full fee remission under option 2 as long as your income is under 13000 (that is for a single person, no kids) you need to bring in evidence so last 3 months statements, latest letter from the job centre and evidence of last 12 months income. If it was me I would try for the remission and if they refuse I would go to the cashpoint and withdraw from the overdraft. It's not great using credit when you know you are insolvent but if you have no other choice, what can you do? It's possible you could get a BRU for it but you would need a very harsh OR for that in my opinion.
Good luck tomorrow! You will be fine at the court I'm sure, I was so nervous as I had never been to a court before. The court clerk will check your forms then you will just wait to see if the judge wants to see you or if he just stamps your form. I didn't see the judge but I understand they just check you have sought advice and checks you are sure!

I can take along my job seekers letter I have which say what I get, the I have only got job seekers twice at the moment since losing my job, and one was paid into my account, but now with going bankrupt I am now getting my job seekers paid into my dad's account until I can open a bank account once I am bankrupt.
I am just going through all the forms again today, I have heard you need 3 copies, who are these for, 1 for the court, and 1 for me what is the 3rd one?

If I dont get a remission then I will have to go to the bank account, luckily though, my county court is by a sainsburys which have banks there so dont have to go to far.Went Bankrupt on 24th July 20130 -
They send the 3rd copy to your OR office.
Try not to worry about tomorrow! It's easy for me to say but just try and remember its just like going to any other government department, you are one of many! I felt really embarrassed but there was no need, the other poor souls were at he court for repossessions and eviction, wondering what I was doing was the least of there worries!
Don't forget if they refuse your remission you have up to 6 months to claim it back, even if you don't meet the remission 2 conditions of earning less than 13000 in 12 months you should still be able to get at least a partial remission under option 3!0
