Advice needed on bankruptcy forms

HI everyone, I am due to go to the court on Monday to petetion for bankruptchy, but I am stuck on a couple of the questions on the forms.

first one is question 3.9 - Do you have the use of a motor vehicle you do not own.

Now that bit is easy yes I do so have put the reg down and the estimated value, I am stuck on the owner though.
My dad is on the registration document and that, but the car is on fiancne still in my dads name, and he is making the monthly payments, the finance is with Santander, so who is the owner Santander or my father? and if I write this car down, they wont take it as an assest wil they? the car is worth £6000 but all I pay towards it is the petrol and bit to insurance to cover me, and some towards tax (if I can)

Also what part do I put down my job seekers allowence, I can only find employment and that, but I am un-employed and on job seekers at the moment.

And the last question is will this be ok for reason becoming bankrupt which is question 11.2

The Loss of my job, and health problems restrict what work I can do, due to back pain can only look for part time work at the moment., I also am suffering from depression, because of the pain, and the loss of my job.

    Dad is the owner. [the car is not on HP]

    It is not an asset in your BR, as it is not your asset.

    However, you can claim for the running costs in the transport section of the SOA....useful if you can prove a 'need'?
    No, I don't think all other drivers are idiots......but some are determined to change my mind.......

    I don't use the car much, just when I have doctors, or to sign on, and for interview etc (when I get an interview), and shopping as I can't carry anything home form the shop because of the my back I'm limited, but I only put about £20 petrol in a month for the amount I drive it, but do put aside my part of the insurance because I'm 25 that has come down now, it's due in April though.

    Q 6.6 reads:
    Do you receive any other income, including state benefits or tax credits? If Yes, state from what source (for example pension, state benefits, part-time earnings) and how much you receive each month?

    As for reasons for bankruptcy, you should probably give a brief explanation of how the debts accrued as well as why you now cannot pay them.

    you are in similar position to I was a month ago filling in the form. also on jsa and using dads car

    re the car put your dads name and value, its your dads car the or can't touch it. I put my dads name and value. add insurance and petrol in section 7 outgoings. I put 20 for petrol and 25 for insurance per month. which is what it is

    add JSA in section 6.6

    re causes I mentioned unemployment plus high interest rates for level of debt, 40k worth and stress and depression this caused therefore BK was the most suitable option.

    also if your living with parents fill in 8.3

    I thought that if the car was on finance then the finance company owns the car? I had a car on finance (conditional sale) and i was told that i put the owner down as Santander? I don't think there is much difference between HP and conditional sale.

    Correct me if iam wrong though.

    Thank you for all the replies, I have phoned citizins advice and my advisor is going to ring me tomorrow to confirm what to do on the car.
    In the meantime is the following ok for outgoings per month.
    My income per month is £310.70 from job seekers

    Rent: £140

    Housekeeping (including food and cleaning) £70

    Gas, ELetric and heating: 0 (this is course its included in the rent, or should I spilt the rent?

    Water: 0 Again included in rent to parents

    Telephone Charges: £15

    Travelling to and from work and other essential journeys: £30 (this could be reduced to £20 if needed.

    Clothing: £20

    Maintenance payments and fines: 0

    Council Tax: 0

    Other Payments: £35 (£25 for Car insurance, and £10 for hair cut)

    Total outgoings £310

    Also on the credit cards and unsercured loans, it asks for date obtained but I cant remember any of them, I know all other details apart from when I got them, is this very important to get this information?

    Have you signed up for noddle? I got all my start dates from my credit report on noddle, it's free. I don't know if you will be able to set it up in time though.

    If you have to, just put an approximate date and explain to the OR when you speak to them that you are not 100% on the dates, I'm sure they will be fine with that!
