    As the company offers an "immediate service", it is therefore exempt from the DSR.

    That is the position they try to sell but in fact it is incorrect. The OFT have made it very clear in their guide to distance selling regulations that 'services' of the type offered by Caveat Viator Ltd cannot equate to the provision of a service. There is no service and therefore no legally binding contract to exempt themselves from. Lodge a small claims application and you will get your money back.
  • Hi guys, never posted on here before. I have unfortunately fallen for this as well. But I got charged £85. That was on Friday and I emailed them straight away and it took them four days to reply. They have offered me half my money back but not the full refubd. I intend to keep on at them until I get my refund. I just can't believe I did this.

    As discussed earlier, their terms are not very fair or moral, but they are legal and available, so it is a case of caveat emptor...

    Out of curiosity, ( I do not want to get into their website), at what point before doing the final submission click was the total fee made apparent on the submission ? I know it is fully stated in the "Prices" tab , but was it drawn to a bottom line statement before you committed ?

    When I got fooled it wasn't made clear at all. So it took payment and then told me I'd been charged £80. Whereas if I'd had to confirm it there's no way I would of spent that much!
  • I too fell for this website thinking it was the real DVLA as it copies their colour scheme etc. I realised my mistake as soon as I hit the enter button and immediately cancelled my application in accordance with their stated terms and conditions. Although they acknowledged my cancellation it has taken 4 weeks and a further 42 e-mails plus 2 recorded delivery letters promising to sue them for breach of contract. (They changed the contact address within their T's & C's which is why I had to send 2 letters).
    Having given them one last chance yesterday by e-mail to give me my money back before I issue legal proceedings I have today received my refund!
    Although what they are doing is legal they do have to comply with their own Terms and Conditions or they are in breach of contract, therefore do not give up trying to get your money back if you use this site in error. They claim to offer 24/7 support etc but they don't seem to work weekends.
  • New here - Not just the scam of charging for the application but entering you into a subscription to e magazines that I certainly don't recall seeing advertised on their web page (it must have been in the T & C's)


    This is long but maybe might help others


    I got stung too trying to re-new the father-in-laws licence (over 80's section). Site looked so credible (Driving-Licence-Application.co.uk), using DVLA colours, logo etc. Site only displaying what they wanted you to see. Applied for licence but it was rejected because I had no passport number - thought nothing of it and expected no charge. No note on the web site at this point that I was being charged.


    I then got 3 emails all within 2 minutes of each other (all from net-secure.co.uk). 1st one entitled "Your free access to our online magazines" which I opened & glanced at but ignored as I hadn't requested access to Automotive World Magazines . The 2nd was entitled "order confirmation" this included a charge of £5 - I felt there should be no charge as the form was rejected - but I decided it was maybe my mistake . The 3rd email confirmed I needed to complete a paper application with DVLA direct.


    End of story - NO! on checking my credit card statement later in the month not only had the company taken the £5 for processing an application that they had rejected BUT 2 DAYS LATER took a further £24. Not knowing what this was for I returned to the emails received and checked them more thoroughly. The email encouraging me to take up free subscriptions to e magazines contained something rather worrying in it's footer:


    "Action against fraud:
    When you used our service the IP address of your computer was recorded in order to prevent any fraudulent activity. All fraudulent claims or payment contestations will be the subject of a formal complaint, communicated to your bank with a letter supporting the original payment and the services requested. You will also be subjected to a block on both your card and computer for use on our site. As a reminder, this service is free of charge for 48 hours, after which time a debit of 24 GBP every two months will be applied.To cancel your subscribtion: click here or call us on: 02035142392"


    The bit in red was well hidden in the tiny font (Not in red & bold as I have shown).


    I was worried to click the link so searched on line for net-secure - Found them and found a section to unsubscribe and a section to ask for refund - I did both - took screen shots of their confirmations.


    Reported it straight to my bank and they unfortunately cannot refund the cost but have put a block on the same company taking any further payments out of my account. Also been told to check statements thoroughly as these companies have a habit of changing their name, so any debit I am unsure of I must report it my bank. I also reported this to Trading Standards & Fraud investigation service but under they said under the T & C's I would struggle. It was suggested I should write to them asking for the refund.


    Still no money credited so visited the site again and tried to see if I could get their postal address - immediately I clicked on contact an IM interaction started, they knew who I was & had my details on their database. I asked why I hadn't received notification of refund and as I was typing an email confirming refund dropped into my inbox. I took screen shots of all what was said. They email only refunded the £24 so I replied to this and requested the £5 also - when all said and done it was them that rejected the application as incomplete. No response initially but about 2 hours later got another email confirming refund of the £5.


    I will only believe this when I see it credited to my account and at that point I intend to email them to remove all my details from their database. Funny cos since dealing with them I appear to be getting a lot of junk sales emails, coincidence who knows?


    So beware!



  • I guess that the distance selling rules don't apply here, as somewhere on their site they'll promise to start providing their "service" immediately. That would mean you can't sue them in the Small Claims Court.
    Can anyone confirm this?
    My niece, 17, was just caught by this one.
