Thanks for that I will add that request.
Just another query that has come to mind whilst reading various other threads.
In my draft appeal I state that 'The driver did enter the store and purchase goods'
To date the actual driver has not been disclosed, would my statement above (which suggests the driver is known) lead me to be forced to name the driver?
PS The appeal has to be submitted by 30th September.
You cannot be forced to 'name the driver' (although some PPCs are trying that tack at the moment), all a PPC can do is 'invite you to name the driver'. You do not have to provide an answer and in not doing so the only person the PPC can pursue under PoFA is the RK.
POPLA shouldn't go anywhere near asking you that question, although if you read Parking Prankster's latest blog you will see they actually did that in one case recently.

Please note that POPLA have absolutely no mandate to ask this question, and in the highly unlikely event of it being asked of you, there is no requirement on you to answer. Let us know if this ever happens. Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

'The driver did enter the store and purchase goods'
.
Apologies if you have already answered this question - but did you ever contact the store and ask them to cancel the charge? Many stores will cancel charges for genuine customers (though the PPCs don't tell you this, obviously!).
Even at this stage it is worth making a complaint to the store about being victimised and penalised for shopping in their store
See this thread for lots of cases where the charge has been cancelled simply by approaching the retailer

I did approach the store but all I was given was a form to submit to VCS, store said basically - nowt to do with us!0 -
Just a quick one if I may?
Which of the 4 boxes on the POPLA form would be most suitable as a reason to appeal?
1 - The vehicle was not improperly parked
2 - The parking charge (ticket) exceeded the appropriate amount
3 - I am not liable for the parking charge
4 - The vehicle was stolen
I don't want to choose the wrong option and have the appeal thrown out on a technicality after all the hard work you guys have helped me with!
Thanks0 -

Is that OK to do? Is it not an excuse to chuck out the appeal?0 -
I am just saving you a trawl through the threads - you'll find the same advice there if you do a search.I'm a retired employment solicitor. Hopefully some of my comments might be useful, but they are only my opinion and not intended as legal advice.0

Right oh, into the post tomorrow morning!0 -
Hi. Has there been an update on this? I'd like to know. Reason being, I was issued with a PCN by VCS yesterday in a Wickes car park even though I pay Wickes a monthly fee to park there!
Wickes have told me to phone VCS and explain that they have made a mistake but I have my doubts about doing that. Should I just wait for the "Notice to Keeper" letter and then go the POPLA route?0 -

Yes - but would that come to you?
POPLA is best because they will wriggle and writhe to avoid giving you a code because it costs them £27.00+VAT
It also costs the BPA a shedload of money because they pay for POPLA.0
