Next step, prepare your draft POPLA appeal. Post it up when you've done it and we'll advise on fine-tuning.Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

Would hope you've already read up on how to win your POPLA appeal seeing as you've been on the forum over 2 months now and even reading just a few other threads would have told you that it would come to this stage.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

When you do your Popla appeal, you must keep on with the lack of entry sign. If you use the BPA COP words in paras 18.1& 18.2 and then say that the BPA have clearly stated that entry signs play an important part in establishing a contract (their words) and the lack of them puts motorists at a disadvantage.
Also attach photos showing no signs.0 -
Is it also worth mentioning in the POPLA appeal about actually using the store and having a receipt for goods purchased?0
-
Yes it is as that proves there is no loss to the parking company, just scan the receipts and post it along with your appeal, did you tell vcs this by the way ?When posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. They DO monitor the forum.
We don't need the following to help you.
Name, Address, PCN Number, Exact Date Of Incident, Date On Invoice, Reg Number, Vehicle Picture, The Time You Entered & Left Car Park, Or The Amount of Time You Overstayed.

Pointless - POPLA is not interested in mitigation.
Why did you not send copy of receipts to VCS as part of your initial appeal?
If you've been reading the threads in the past 2 months you'd have seen just how successful the strategy has been to complain to the retailer, copy them the receipts (or better, take them in with you) and assertively demand they cancel the charge.
But do this in PARALLEL with putting your POPLA appeal together. Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

You are right they don't do mitigation, but it strengthens the fact that there is no loss to the parking company, how can there be when the person is shopping? There is no harm in adding this to the rest of the appeal and pointing it to poplaWhen posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. Agree - no harm, but not something the OP should see as his 'killer point'.Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

Sounds like this error I made may be the nail in the coffin and the POPLA appeal would come to nothing.
Might be as well just to stop here, pay and put it down to experience.
The missus is getting stressed over it all too.0
