Just before you do send this off, a new thread on here https://forums.moneysavingexpert.com/discussion/4689253 has appeared. A PPC has defined what is included in their pre-estimate of loss.
These are costs of running a company and can't be included in the loss. Worth checking out whether or not it's the same PPC.
Also, you could include the following in the section about the pre-estimate of loss.
"If the pre-estimate of loss contains any of the following, then I contend that these are the costs of running a business and I require the PPC to confirm to POPLA whether or not the pre-estimate of loss contains some or all elements of
• Erection and maintenance of the site signage."
• Installation, monitoring and maintenance of the Automatic Number Plate Recognition systems.
• Employment of office-based administrative staff.
• Membership and other fees required to manage the business effectively including those paid to the SPA, DVLA and ICO.
• General costs including stationery, postage, etc.0 -

Many, many thanks to Coupon-mad and Guys Dad for all the help and advice that has been given, i really could not have done this without it. I would have just ended up being anothe mug who would have just paid the fine. You have given me confidence and a voice to fight anything like this in the future. Lets hope all goes my way at the appeal. I will keep you all posted.0

This is a very important point and probably the reason so many people get stung by PE for short overstays at Tower Road and Fistral.
Whilst PE might state that they have 'compliant' signs galore, how many people realise the clock is ticking the instant they enter the car park ?
How many people realise that however long any 'grace' period is allowed, it combines the time before ticket purchase and the time after.
In many ways Tower Road and Fistral are quite unlike retail and supermarket car parks. Very often people will have driven long distances with a 'vehicle' load of family, friends and luggage and reasonable time should be allowed prior to purchasing the ticket as well as for leaving.
Whilst the BPA code of practice 13.4 covers 'leaving' time is there anything about the difference between time of arrival and time of purchase ?
Are there highly visible signs as you enter stating 'YOUR PARKING CHARGES START NOW - NOT WHEN YOU PURCHASE THE TICKET'
This is the subtle difference between a council type, non barriered P&D car park and a PE 'managed' one and it is this that catches so many people out.
Obviously PE have no interest in making sure that people know this.
I can't say for Tower Road but at Fistral there are some 'top up your payment before you leave signs' but most people would imagine they refer to overstays after the ticket has expired. When I last looked they didn't appear to suggest topping up to cover the time of arrival to time of purchase of the ticket.0 -
There are signs saying top up before you leave but there are no signs to my knowledge saying thaht you are charged from the moment you enter and leave the car park rather than from the time you purchase the ticket. You just assume you are charged from when you purchase the ticket for how long you purchase it for and if you think you are going to be longer then you just come back and top it up. You also assume as there are no signs telling you that you are charged from the moment you enter and leave the car park that the car park would be warden controlled and as long as you are back in time before the ticket runs out that you will be fine!!! But oh no not with these cowboy car parkers!!!!0

Don't know about Tower but Fistral is owned by Brittanic Industries; if it were me I wouldn't even mention Parking Eye, I would tell T.S. that Brittanic Industries is operating its car park illegally.Je suis Charlie.0 -

Im no good with wording letters, but if anyone wants to knock one up for me then i will be more than happy to send it off to Trading Standards. Dont know if anything will be done about it though or how many letters they need for something to be done about it???0

Another poster confirmed that the creditor named on a PE/Fistral court claim was Fistral Beach Ltd. However they and Britanic Industries Ltd have the same directors0
